Bu durum, yaln\u0131zca hamile kad\u0131n\u0131n durumuyla ilgili olmad\u0131\u011f\u0131n\u0131n kan\u0131tlanabildi\u011fi istisnai durumlarda dikkate al\u0131n\u0131r. Bununla ba\u011flant\u0131l\u0131 olarak, \u00e7al\u0131\u015fan\u0131n s\u00f6zle\u015fmesel y\u00fck\u00fcml\u00fcl\u00fcklerini \u00f6zellikle ciddi bir \u015fekilde ihlal etmesi nedeniyle \u00e7al\u0131\u015fanla i\u015f ili\u015fkisinin devam\u0131n\u0131n makul olmamas\u0131 gerekir.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.vgh.bayern.de\/media\/bayvgh\/presse\/12a00264b.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">VGH M\u00fcnih, 29.02.2012 tarihli karar \u2013 12 C 12.264<\/a><\/p>\n\n\n\n<p>Ancak, i\u00e7tihatlar, i\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 \u00f6zel koruma sa\u011flanan hamile kad\u0131nlar\u0131n \u00e7\u0131karlar\u0131n\u0131n hukuken daha \u00f6nemli kabul edildi\u011fini vurgulamaktad\u0131r. Hakaret veya a\u015fa\u011f\u0131lay\u0131c\u0131 olmayan g\u00f6r\u00fc\u015f ifadeleri, genellikle i\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 \u00f6zel koruman\u0131n reddedilmesini hakl\u0131 \u00e7\u0131karmaz.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-betriebsbedingte-gr-nde-als-besonderer-ausnahmefall\">\u00d6zel bir istisna olarak operasyonel nedenler<\/h3>\n\n\n\n<p>\u0130\u015fletmenin kapanmas\u0131 gibi operasyonel nedenler, yetkili makam\u0131n prensip olarak feshe izin verebilece\u011fi \u00f6zel bir istisna te\u015fkil eder. Ancak bu gibi durumlarda \u00f6n ko\u015ful, gelecekte istihdam olanaklar\u0131n\u0131n art\u0131k mevcut olmamas\u0131d\u0131r. Augsburg \u0130dare Mahkemesi gerek\u00e7esini \u015f\u00f6yle a\u00e7\u0131klam\u0131\u015ft\u0131r:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u0130\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 koruma, \u00e7al\u0131\u015fan\u0131n ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamaya hizmet etmez. Ancak, i\u015fverenin koruma s\u00fcresi boyunca i\u015fletmenin kapanmas\u0131na ra\u011fmen \u00fccret \u00f6demeye devam etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc devam ederse ve ekonomik olarak makul olmayan, \u00f6z\u00fcn\u00fc kesin olarak yitirmi\u015f bir istihdam ili\u015fkisi s\u00fcrd\u00fcr\u00fcl\u00fcrse, b\u00f6yle bir h\u00fck\u00fcm fiilen uygulanacakt\u0131r. [...] Bu nedenle, mevcut davada oldu\u011fu gibi, i\u015fletmenin kal\u0131c\u0131 olarak kapat\u0131lmas\u0131 durumunda, genellikle \u00f6zel bir durumun var oldu\u011fu varsay\u0131l\u0131r.<\/p>\n<cite><a href=\"https:\/\/www.gesetze-bayern.de\/Content\/Document\/Y-300-Z-BECKRS-B-2018-N-31720?hl=true&amp;AspxAutoDetectCookieSupport=1\" target=\"_blank\" rel=\"noreferrer noopener\">Augsburg \u0130dare Mahkemesi, 20 Kas\u0131m 2018 tarihli karar \u2013 3 K 18.1459<\/a><\/cite><\/blockquote>\n\n\n\n<p>Ancak ki\u015fisel nedenler \u00f6zel bir istisnay\u0131 hakl\u0131 g\u00f6steremez.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-allgemeiner-k-ndigungsschutz-bei-zustimmung-der-beh-rde\">Yetkili makam\u0131n onay\u0131 ile i\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 genel koruma<\/h3>\n\n\n\n<p>Yetkili makam\u0131n feshi kabul edilebilir bulmas\u0131, feshin ge\u00e7erli oldu\u011fu anlam\u0131na gelmez. Aksine, feshin ge\u00e7erlili\u011fi, Fesih Koruma Kanunu kapsam\u0131ndaki bi\u00e7imsel gereklilikler ve genel i\u015ften \u00e7\u0131karmaya kar\u015f\u0131 koruma ile \u00f6l\u00e7\u00fclmelidir.
