A\u011f\u0131r engelli ki\u015filere i\u015f ili\u015fkilerinde de \u00f6zel koruma sa\u011flan\u0131yor ve \u00f6zel haklar tan\u0131n\u0131yor. \u0130\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 \u00f6zel koruma \u00f6zellikle \u00f6nemli. <a href=\"https:\/\/www.gesetze-im-internet.de\/sgb_9_2018\/__168.html\" target=\"_blank\" rel=\"noreferrer noopener\">B\u00f6l\u00fcm 168 SGB IX<\/a>\u015e\u00f6yle diyor:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>A\u011f\u0131r engelli bir ki\u015finin i\u015f s\u00f6zle\u015fmesinin i\u015fveren taraf\u0131ndan feshedilmesi i\u00e7in Entegrasyon Ofisi&#039;nin \u00f6nceden onay\u0131 gerekir.<\/p>\n<\/blockquote>\n\n\n\n<p><strong>Bu, \u015funu yapacakt\u0131r: <\/strong>A\u011f\u0131r engelli ki\u015filerin \u00e7\u0131karlar\u0131, i\u015ften \u00e7\u0131karman\u0131n resmi denetime tabi tutulmas\u0131yla, i\u015ften \u00e7\u0131karma duyurulmadan \u00f6nce bile korunur. \u0130\u015fveren, r\u0131zas\u0131 al\u0131nmadan yap\u0131lan bir i\u015ften \u00e7\u0131karman\u0131n Entegrasyon Ofisi&#039;nin onay\u0131na tamamen ba\u011fl\u0131d\u0131r. <a href=\"https:\/\/www.gesetze-im-internet.de\/bgb\/__134.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 134 Alman Medeni Kanunu<\/a> etkisizdir.<\/p>\n\n\n\n<p><a href=\"https:\/\/research.wolterskluwer-online.de\/document\/0d9eab93-bb80-4290-90ab-a2aa76508874\" target=\"_blank\" rel=\"noreferrer noopener\">BAG, 16.03.1994 tarihli karar \u2013 8 AZR 688\/92<\/a><\/p>\n\n\n\n<div class=\"gradient-border red-gradient p-4 mb-3\"><em>Not: \u0130\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 \u00f6zel koruma, i\u015ften \u00e7\u0131karmalar ve i\u015f s\u00f6zle\u015fmesinde de\u011fi\u015fiklik i\u00e7eren fesih bildirimleri i\u00e7in de ayn\u0131 \u015fekilde ge\u00e7erlidir. Ancak, fesih s\u00f6zle\u015fmeleri, belirli s\u00fcreli s\u00f6zle\u015fmeler veya i\u015f ili\u015fkisinin di\u011fer \u015fekillerde sona erdirilmesi hallerinde ge\u00e7erli de\u011fildir.<\/em><\/div>\n\n\n\n<div class=\"gradient-border red-gradient p-4 mb-3\"><em>\u00d6nemli not: Entegrasyon Ofisi&#039;nin onay\u0131 olmadan yap\u0131lan fesih ge\u00e7ersizdir ve \u00e7al\u0131\u015fan taraf\u0131ndan itiraz edilebilir. Ancak, bir \u00e7al\u0131\u015fan olarak haks\u0131z fesih davas\u0131 a\u00e7mak i\u00e7in \u00fc\u00e7 haftal\u0131k s\u00fcrenin dolmas\u0131na izin verirseniz, fesih yine de ge\u00e7erli olabilir. Bu durumda, i\u015fveren a\u011f\u0131r engellili\u011fin fark\u0131nda de\u011filse ve fesih bildirimini ald\u0131ktan sonraki \u00fc\u00e7 hafta i\u00e7inde fark\u0131na varmam\u0131\u015fsa fesih ge\u00e7erli olur.<\/em><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"voraussetzungen_sonderk\u00fcndigungsschutz\">A\u011f\u0131r engelli ki\u015filer i\u00e7in i\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 \u00f6zel koruma gereklilikleri<\/h2>\n\n\n\n<p>\u0130\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 \u00f6zel koruma <strong>olgusal ve ki\u015fisel ko\u015fullar<\/strong> Bunlar \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Objektif a\u011f\u0131r engellili\u011fin varl\u0131\u011f\u0131<\/li>\n\n\n\n<li>En az 30 engellilik derecesi olanlara e\u015fitlik<\/li>\n\n\n\n<li>Fesih bildiriminin al\u0131nd\u0131\u011f\u0131 tarihte i\u015f ili\u015fkisinin 6 aydan uzun s\u00fcredir kesintisiz devam ediyor olmas\u0131<\/li>\n<\/ul>\n\n\n\n<p>A\u011f\u0131r engellilik tan\u0131nmas\u0131 veya e\u015fit muamele tan\u0131nmas\u0131 ba\u015fvurusunda bulunulmas\u0131 al\u0131\u015f\u0131lmad\u0131k bir durum de\u011fil, ancak yetkili makam yeterince h\u0131zl\u0131 karar vermiyor. Bu arada, \u00e7al\u0131\u015fan i\u015ften \u00e7\u0131kar\u0131lma bildirimi al\u0131yor. Bu gibi durumlarda \u00f6zel i\u015ften \u00e7\u0131karma korumas\u0131 hala ge\u00e7erli mi? Cevap: hem evet hem hay\u0131r; duruma g\u00f6re de\u011fi\u015fir.<\/p>\n\n\n\n<p><strong>A\u011f\u0131r engelli ki\u015filer:<\/strong> Burada belirleyici etken, (1) a\u011f\u0131r engellilik tespitinin \u00fc\u00e7 hafta \u00f6nce yap\u0131lm\u0131\u015f olmas\u0131 ve (2) i\u015fverenin a\u011f\u0131r engellilikten haberdar olmas\u0131, ancak her durumda (3) bunu ald\u0131ktan sonra en ge\u00e7 \u00fc\u00e7 hafta i\u00e7inde \u00f6\u011frenmi\u015f olmas\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>Ayn\u0131 derecede a\u011f\u0131r engelli ki\u015filer:<\/strong> Burada da (1) e\u015fit muamelenin tan\u0131nmas\u0131, fesih bildiriminin al\u0131nmas\u0131ndan \u00fc\u00e7 hafta \u00f6nce talep edilmi\u015f olmal\u0131 ve (2) i\u015fveren e\u015fit muameleden haberdar olmal\u0131 veya (3) fesih bildiriminin al\u0131nmas\u0131ndan itibaren \u00fc\u00e7 hafta i\u00e7inde \u00f6\u011frenilmelidir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A\u011f\u0131r engelli \u00e7al\u0131\u015fan\u0131n iki temel g\u00f6revi<\/h3>\n\n\n\n<p>\u00d6zetle, \u00e7al\u0131\u015fan\u0131n fesih bildirimini almadan en az \u00fc\u00e7 hafta \u00f6nce rehabilitasyon kurumuna ba\u015fvuruda bulunmas\u0131 gerekmektedir. Engellilik veya e\u015fit f\u0131rsatlara ra\u011fmen i\u015ften \u00e7\u0131karmalarla ba\u015fa \u00e7\u0131kma konusundaki deneyimimize g\u00fcvenin.<\/p>\n\n\n\n<div class=\"buttons-block flex flex-wrap justify-center mt-12\"> <a class=\"btn-cta mr-0 sm:mr-3 text-dark\" href=\"tel:+4940524717830\"> <i class=\"fa fa-phone mr-2\"><\/i> Hemen aray\u0131n <\/a> <a class=\"btn-cta mr-0 sm:mr-3 text-dark\" href=\"\/tr\/kontakt\/\"> <i class=\"fa fa-envelope mr-2\"><\/i> \u00dccretsiz ilk de\u011ferlendirme<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"entscheidung_integrationsamt\">Entegrasyon Ofisinin fesih onay\u0131na ili\u015fkin karar\u0131<\/h2>\n\n\n\n<p>Entegrasyon Ofisi, i\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 \u00f6zel koruman\u0131n amac\u0131na uygun olarak, a\u011f\u0131r engelli ki\u015fileri i\u015ften \u00e7\u0131kar\u0131lman\u0131n \u015fiddetinden korumaya kendi takdiriyle karar verir. <strong>\u00c7al\u0131\u015fan\u0131n ve i\u015fverenin \u00e7\u0131karlar\u0131 birbirine kar\u015f\u0131 tart\u0131l\u0131r<\/strong>, a\u015fa\u011f\u0131daki h\u00fck\u00fcm ge\u00e7erlidir: Fesih, \u00e7al\u0131\u015fan\u0131n engellili\u011fiyle ne kadar az ilgiliyse, \u00e7al\u0131\u015fan\u0131n \u00e7\u0131karlar\u0131 o kadar \u00f6nemsiz hale gelir. Federal \u0130dare Mahkemesi bu konuda \u015fu karar\u0131 vermi\u015ftir:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Federal \u0130dare Mahkemesi, i\u015f ili\u015fkisinin sona erdirilmesinin engellili\u011fin kendisinden kaynaklanan nedenlere dayanmas\u0131 halinde a\u011f\u0131r engelli ki\u015filerin korunmas\u0131n\u0131n \u00f6nem kazand\u0131\u011f\u0131n\u0131 ve bu nedenle, a\u011f\u0131r engelliler kanununda ifade edilen rehabilitasyon koruyucu fikrinin uygulanabilmesi i\u00e7in, i\u015fverenin \u00e7\u0131karlar\u0131 dengeleyen takdiri karar ba\u011flam\u0131nda dikkate al\u0131nmas\u0131 gereken makull\u00fck s\u0131n\u0131r\u0131n\u0131n \u00f6zellikle y\u00fcksek olmas\u0131 gerekti\u011fini daha \u00f6nce de \u00e7e\u015fitli vesilelerle belirtmi\u015ftir. <a href=\"https:\/\/research.wolterskluwer-online.de\/document\/810dda48-637e-46d5-9fbc-a50ffb073ac3\" target=\"_blank\" rel=\"noreferrer noopener\">BVerwG, 19 Ekim 1995 tarihli karar \u2013 5 C 24\/93<\/a><\/p>\n<\/blockquote>\n\n\n\n<p>Bu, Entegrasyon Ofisi&#039;nin <strong>Daha sonra onay vermek<\/strong> Bunun nedeni, \u00f6zel i\u015ften \u00e7\u0131karma korumas\u0131n\u0131n genellikle a\u011f\u0131r engelli ki\u015filerin yasal korumas\u0131n\u0131 iyile\u015ftirmeyi ama\u00e7lamas\u0131d\u0131r. Ancak, a\u015fa\u011f\u0131daki durumlarda durum farkl\u0131 olabilir: <strong>ki\u015fisel nedenlerle i\u015ften \u00e7\u0131kar\u0131lma<\/strong> Bunun nedeni, a\u011f\u0131r engellilik ile hastal\u0131k d\u00f6nemleri aras\u0131nda s\u0131kl\u0131kla bir ba\u011flant\u0131 olmas\u0131d\u0131r.
