Baden-W\u00fcrttemberg Eyalet \u0130\u015f Mahkemesi, bu cinsiyete dayal\u0131 hukuka ayk\u0131r\u0131 ayr\u0131mc\u0131l\u0131\u011f\u0131 de\u011ferlendirdi ve \u015firketin tazminat \u00f6demesine karar verdi.<\/p>\n\n\n\n<p>\u015eirketlerin bu karardan ne gibi sonu\u00e7lar \u00e7\u0131karmas\u0131 gerekti\u011fini buradan \u00f6\u011frenin!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"agg_entsch\u00e4digung\"><strong>AGG tazminat\u0131: Mimar, in\u015faat \u015firketinin ayr\u0131mc\u0131l\u0131\u011f\u0131 nedeniyle tazminat ald\u0131<\/strong><\/h2>\n\n\n\n<p>Bir in\u015faat \u015firketinin sat\u0131\u015f departman\u0131nda \u00e7al\u0131\u015fan bir mimar, \u015firket i\u00e7i destek sistemi arac\u0131l\u0131\u011f\u0131yla potansiyel bir m\u00fc\u015fteriye atanm\u0131\u015ft\u0131. Ancak potansiyel m\u00fc\u015fteri, kad\u0131n dan\u0131\u015fman istemedi\u011fi i\u00e7in mimarla \u00e7al\u0131\u015fmay\u0131 reddetti ve do\u011frudan \u015firketin b\u00f6lge m\u00fcd\u00fcr\u00fcyle ileti\u015fime ge\u00e7ti. M\u00fcd\u00fcr, m\u00fc\u015fterinin deste\u011fini kendisi \u00fcstlenmeye karar verdi ve mimar\u0131 projeden \u00e7\u0131kard\u0131.<\/p>\n\n\n\n<p>D\u0131\u015flanmaya ra\u011fmen, mimar itirazda bulundu ve m\u00fcstakbel m\u00fcteahhitle tekrar ileti\u015fime ge\u00e7meye \u00e7al\u0131\u015ft\u0131, ancak bu giri\u015fim ba\u015far\u0131s\u0131z oldu. M\u00fcstakbel m\u00fcteahhit, erkek dan\u0131\u015fman iste\u011fini yineledi ve mimarla yapt\u0131\u011f\u0131 g\u00f6r\u00fc\u015fmeden sonra &quot;k\u00f6t\u00fc bir his&quot; duydu\u011funu belirtti. \u0130lk ifadesinden pi\u015fmanl\u0131k duysa da, erkek dan\u0131\u015fman tercihini s\u00fcrd\u00fcrd\u00fc. Buna kar\u015f\u0131l\u0131k, Baden-W\u00fcrttemberg Eyalet \u0130\u015f Mahkemesi (20 Kas\u0131m 2024 tarihli, dava numaras\u0131 10 Sa 13\/24) yarg\u0131 yetkisinin geri \u00e7ekilmesinin mimar\u0131 ger\u00e7ekten dezavantajl\u0131 duruma d\u00fc\u015f\u00fcrd\u00fc\u011f\u00fcne h\u00fckmetti ve kendisine 1.500 Avro tazminat \u00f6denmesine karar verdi. Mahkeme, in\u015faat \u015firketinin i\u015f hukuku kapsam\u0131nda mimara kar\u015f\u0131 koruma g\u00f6revini yerine getirmesi gerekti\u011fine h\u00fckmetti. Mimar\u0131n niteliklerini vurgulamadan ve daha fazla a\u00e7\u0131klama talep etmeden, m\u00fcstakbel m\u00fcteahhidin ayr\u0131mc\u0131 isteklerine uymak haks\u0131zd\u0131.<\/p>\n\n\n\n<p>Karar, i\u015fverenlerin \u00e7al\u0131\u015fanlar\u0131n\u0131 m\u00fc\u015fteriler gibi \u00fc\u00e7\u00fcnc\u00fc taraflar\u0131n ayr\u0131mc\u0131l\u0131\u011f\u0131ndan koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc oldu\u011funu g\u00f6stermektedir. Bu y\u00fck\u00fcml\u00fcl\u00fc\u011fe uyulmamas\u0131 do\u011frudan ayr\u0131mc\u0131l\u0131k olarak de\u011ferlendirilebilir ve tazminat taleplerine yol a\u00e7abilir.
