K\u0131sa \u00e7al\u0131\u015fma d\u00f6nemi sona erdikten sonra 1 Haziran 2021&#039;de i\u015fe d\u00f6nmesi planlan\u0131yordu. Bu arada, i\u015fveren k\u0131lavuzu g\u00fcncelledi. Bu k\u0131lavuza g\u00f6re, s\u00fcr\u00fcc\u00fclerin d\u00fczenli olarak COVID-19 kendi kendine test yapt\u0131rmalar\u0131 gerekiyor. K\u0131lavuzda ayr\u0131ca \u015funlar da belirtiliyordu:<\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong><em>\u201c\u0130\u015fe ba\u015flad\u0131\u011f\u0131n\u0131z ilk g\u00fcn, vardiyan\u0131z ba\u015flamadan \u00f6nce g\u00f6zetim alt\u0131nda yerinde bir test yap\u0131lacakt\u0131r.\u201d<\/em><\/strong><\/p>\n\n\n\n<p>\u00c7al\u0131\u015fan, 1 Haziran 2021&#039;de i\u015fe ba\u015flamadan \u00f6nce bu testi reddetti. Ayr\u0131ca, i\u015fveren taraf\u0131ndan sa\u011flanan test kitlerini de almay\u0131 reddetti. \u0130\u015fveren daha sonra \u00e7al\u0131\u015fana 1 Haziran 2021 i\u00e7in \u00fccretsiz izin verdi.<\/p>\n\n\n\n<p>\u00c7al\u0131\u015fan\u0131n bu davran\u0131\u015f\u0131 02.06.2021 ve 03.06.2021 tarihlerinde tekrarlanm\u0131\u015f ve sonu\u00e7ta i\u015fyerinden ve i\u015fyerinden yasaklanmas\u0131yla sonu\u00e7lanm\u0131\u015ft\u0131r. <a href=\"https:\/\/smart-arbeitsrecht.de\/tr\/kuendigung-des-arbeitsvertrages-kuendigungsschutz\/\">\u0130\u015ften \u00e7\u0131kar\u0131lma<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Korona testlerinin reddedilmesi: Davran\u0131\u015fsal nedenlerle i\u015ften \u00e7\u0131karma hukuka ayk\u0131r\u0131d\u0131r<\/h2>\n\n\n\n<p>Mahkeme, \u00f6ncelikle bir i\u015f ili\u015fkisinde h\u0131zl\u0131 koronavir\u00fcs testi yap\u0131lmas\u0131 emrinin hukuka uygun olup olmad\u0131\u011f\u0131 sorusunu ayr\u0131nt\u0131l\u0131 bir \u015fekilde ele ald\u0131. Bu soruyu ayr\u0131nt\u0131l\u0131 bir gerek\u00e7eyle olumlu yan\u0131tlad\u0131 ve emrin i\u015fverenin y\u00f6nlendirme hakk\u0131 kapsam\u0131nda oldu\u011funu vurgulad\u0131. Mahkeme, \u00e7al\u0131\u015fan\u0131n fiziksel b\u00fct\u00fcnl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahalenin son derece s\u0131n\u0131rl\u0131 oldu\u011funu, \u00e7\u00fcnk\u00fc sadece burnunun \u00f6n taraf\u0131ndan s\u00fcr\u00fcnt\u00fc \u00f6rne\u011fi al\u0131nd\u0131\u011f\u0131n\u0131 belirtti.<\/p>\n\n\n\n<p>Testle ili\u015fkili ki\u015fisel haklara y\u00f6nelik m\u00fcdahale de k\u00fc\u00e7\u00fck yo\u011funluktayd\u0131. \u0130\u015fveren, \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc nedeniyle, <a href=\"https:\/\/www.gesetze-im-internet.de\/bgb\/__618.html\">\u00a7 618 Alman Medeni Kanunu<\/a> ile birlikte <a href=\"https:\/\/www.gesetze-im-internet.de\/arbschg\/__3.html\">B\u00f6l\u00fcm 3 paragraf 1 ArbSchG<\/a> \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131\u011f\u0131na kar\u015f\u0131 a\u00e7\u0131k bir \u00fcst\u00fcn ilgi g\u00f6sterebilir.<\/p>\n\n\n\n<p>\u0130\u015fverenin test emrinin yasal olmas\u0131na ra\u011fmen, onun taraf\u0131ndan verilen emir <a href=\"https:\/\/smart-arbeitsrecht.de\/tr\/verhaltensbedingte-kuendigung-grosser-ratgeber\/\">uygunsuz davran\u0131\u015f nedeniyle i\u015ften \u00e7\u0131kar\u0131lma<\/a> ge\u00e7ersiz. \u0130\u015fveren \u00e7al\u0131\u015fana \u00f6nceden uyar\u0131da bulunmam\u0131\u015f veya mahkeme uyar\u0131 verildi\u011finden emin olamam\u0131\u015ft\u0131r. Mahkeme, \u00f6nceden uyar\u0131n\u0131n kesinlikle gerekli oldu\u011funu, \u00e7\u00fcnk\u00fc &quot;telif hakk\u0131 ihlalinin [eksik] \u00f6nlenmesi, &quot;i\u015fe devam etmeme&quot; gibi daha hafif bir \u00f6nlem oldu\u011funu de\u011ferlendirmi\u015ftir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Korona testlerinin reddedilmesi i\u015ften \u00e7\u0131kar\u0131lmaya yol a\u00e7abilir<\/h2>\n\n\n\n<p>Bana g\u00f6re mahkeme do\u011fru karar\u0131 vermi\u015f ve gerek\u00e7esi de ikna edici. Fesih her zaman son \u00e7aredir. \u00d6nceden verilen bir uyar\u0131n\u0131n, \u00e7al\u0131\u015fan\u0131n davran\u0131\u015flar\u0131nda bir de\u011fi\u015fikli\u011fe yol a\u00e7abilece\u011fi g\u00f6z ard\u0131 edilemez. Do\u011fru bir uyar\u0131, \u00e7al\u0131\u015fana &quot;\u0130\u015f ili\u015fkiniz tehlikede&quot; mesaj\u0131n\u0131 verir.<\/p>\n\n\n\n<p>Bu, bir i\u015f ili\u015fkisinde uyar\u0131n\u0131n ne kadar \u00f6nemli oldu\u011funu bir kez daha g\u00f6steriyor.
