Bu tesisler aras\u0131nda \u015funlar yer almaktad\u0131r: <strong>Hastaneler, g\u00fcnl\u00fck klinikler, doktor ve di\u015f hekimi muayenehaneleri veya yat\u0131l\u0131 tedavi tesisleri<\/strong> Ya\u015fl\u0131, engelli veya bak\u0131ma muhta\u00e7 ki\u015filerin bak\u0131m\u0131 i\u00e7in. Mart 2022 ortas\u0131ndan itibaren bu tesislerde \u00e7al\u0131\u015fmak isteyen ki\u015filerin, a\u015f\u0131lanm\u0131\u015f veya iyile\u015fmi\u015f ki\u015filer olmas\u0131 gerekmektedir. <a href=\"https:\/\/www.gesetze-im-internet.de\/schausnahmv\/BJNR612800021.html\" target=\"_blank\" rel=\"noreferrer noopener\">COVID-19 Koruyucu \u00d6nlemler \u0130stisna Y\u00f6netmeli\u011fi<\/a> olmak.<\/p>\n\n\n\n<p>D\u00fczenlemenin gerek\u00e7esinde, a\u00e7\u0131klay\u0131c\u0131 notta, belirli ki\u015fi gruplar\u0131n\u0131n sa\u011fl\u0131k durumlar\u0131 veya ya\u015flar\u0131 nedeniyle, <strong>\u015fiddetli veya \u00f6l\u00fcmc\u00fcl COVID-19 hastal\u0131\u011f\u0131 riskinin artmas\u0131<\/strong> Ancak pandeminin ba\u015flang\u0131c\u0131ndan bu yana \u00f6zellikle hastaneler ve huzurevlerinde koronavir\u00fcs salg\u0131nlar\u0131 tekrar tekrar ya\u015fanm\u0131\u015f, baz\u0131 vakalarda \u00e7ok y\u00fcksek \u00f6l\u00fcm oranlar\u0131na ula\u015f\u0131lm\u0131\u015ft\u0131r. <\/p>\n\n\n\n<p>Yasama organ\u0131, sa\u011fl\u0131k mesleklerindeki personelin \u00f6zel bir sorumlulu\u011fa sahip oldu\u011funu varsaymaktad\u0131r, \u00e7\u00fcnk\u00fc <strong>yo\u011fun temas<\/strong> \u015eiddetli ve \u00f6l\u00fcmc\u00fcl bir COVID-19 hastal\u0131\u011f\u0131na yakalanma riski y\u00fcksek olan gruplara y\u00f6neliktir. Yasama organ\u0131na g\u00f6re, g\u00fcvenilir koruma ancak bu mesleklerdeki personel aras\u0131nda y\u00fcksek a\u015f\u0131lama oran\u0131yla sa\u011flanabilir. Bu, \u00f6zellikle savunmas\u0131z gruplar\u0131n koronavir\u00fcse yakalanma riskini azaltacakt\u0131r. A\u015f\u0131lanm\u0131\u015f ve iyile\u015fmi\u015f bireylerin enfekte olma ve dolay\u0131s\u0131yla koronavir\u00fcs ta\u015f\u0131y\u0131c\u0131s\u0131 olma olas\u0131l\u0131\u011f\u0131 daha d\u00fc\u015f\u00fckt\u00fcr. <\/p>\n\n\n\n<p>Genel olarak a\u015f\u0131lanm\u0131\u015f ve iyile\u015fmi\u015f ki\u015filerdeki riskin \u00f6nemli \u00f6l\u00e7\u00fcde daha d\u00fc\u015f\u00fck oldu\u011fu varsay\u0131l\u0131yor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"teilimpfpflicht_nachweispflicht\">&quot;K\u0131smi a\u015f\u0131lama zorunlulu\u011fu&quot; asl\u0131nda bir kan\u0131t gereklili\u011fidir<\/h2>\n\n\n\n<p>Hukuki sonu\u00e7lar\u0131na bakmadan \u00f6nce <a href=\"https:\/\/www.gesetze-im-internet.de\/ifsg\/__20a.html\" target=\"_blank\" rel=\"noreferrer noopener\">Enfeksiyon Koruma Yasas\u0131&#039;n\u0131n 20a B\u00f6l\u00fcm\u00fc<\/a> Bu konuyu tart\u0131\u015fmadan \u00f6nce, yayg\u0131n bir yanl\u0131\u015f anlamay\u0131 ortadan kald\u0131rmam\u0131z gerekti\u011fini d\u00fc\u015f\u00fcn\u00fcyoruz. S\u00f6zde &quot;k\u0131smi a\u015f\u0131lama zorunlulu\u011fu&quot; asl\u0131nda bir a\u015f\u0131lama zorunlulu\u011fu de\u011fildir. Enfeksiyon Koruma Yasas\u0131&#039;n\u0131n 20a Maddesi&#039;nde, ilgili ki\u015filere ve \u00e7al\u0131\u015fanlara a\u015f\u0131 olma zorunlulu\u011fu getirilmemi\u015ftir.<\/p>\n\n\n\n<p>Kanun, yaln\u0131zca Enfeksiyon Koruma Yasas\u0131&#039;n\u0131n 20a Maddesi 2. F\u0131kras\u0131nda, yukar\u0131da belirtilen kurulu\u015flarda \u00e7al\u0131\u015fan ki\u015filerin ilgili kurulu\u015f veya \u015firketin y\u00f6netimine rapor vermeleri gerekti\u011fini \u00f6ng\u00f6rmektedir. <strong>Alternatif olarak, a\u015fa\u011f\u0131daki delillerin 15 Mart 2022 tarihine kadar sunulmas\u0131 gerekmektedir:<\/strong> sahip olmak:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>COVID-19 Koruyucu \u00d6nlemler \u0130stisna Y\u00f6netmeli\u011fi uyar\u0131nca ge\u00e7erli bir a\u015f\u0131 belgesi<\/li><li>Y\u00f6netmelik anlam\u0131nda tahsilat\u0131n ispat\u0131<\/li><li>T\u0131bbi kontrendikasyon nedeniyle koronavir\u00fcs a\u015f\u0131s\u0131 olamayaca\u011f\u0131na dair sa\u011fl\u0131k raporu<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"besch\u00e4ftigungsverbot_neue_arbeitnehmer\">Mart 2022 ortas\u0131ndan itibaren yeni \u00e7al\u0131\u015fanlar i\u00e7in istihdam yasa\u011f\u0131<\/h2>\n\n\n\n<p>Bu kan\u0131t\u0131n 15 Mart 2022 tarihine kadar sunulmamas\u0131 halinde kurum; <strong>sorumlu sa\u011fl\u0131k otoritesini derhal bilgilendirmek<\/strong>Bu ama\u00e7la, tesis, bireylerin (\u00e7al\u0131\u015fanlar dahil) ki\u015fisel verilerini de iletebilir. Sa\u011fl\u0131k otoritesi daha sonra a\u015f\u0131 veya iyile\u015fme kan\u0131t\u0131 talep edebilir. Ki\u015fi bu talebi makul bir s\u00fcre i\u00e7inde yerine getirmezse, sa\u011fl\u0131k otoritesi: <strong>Eri\u015fim veya faaliyet yasa\u011f\u0131<\/strong> ifade etmek.<\/p>\n\n\n\n<p>Enfeksiyon Koruma Kanunu&#039;nda, sa\u011fl\u0131k otoritesinin herhangi bir emrinden ba\u011f\u0131ms\u0131z olarak ge\u00e7erli olan ba\u015fka bir d\u00fczenleme daha bulunmaktad\u0131r: 16 Mart 2022 tarihinden itibaren ilgili tesislerde &quot;\u00e7al\u0131\u015facak&quot; ki\u015filer i\u00e7in, tesis y\u00f6netimine belge sunma zorunlulu\u011fu da ge\u00e7erlidir. Bu ki\u015filer a\u015f\u0131 veya iyile\u015fme belgesi sunmazlarsa, ba\u015flang\u0131\u00e7tan itibaren tesislerde \u00e7al\u0131\u015fmalar\u0131na izin verilmeyecektir. <strong>ne \u00e7al\u0131\u015f\u0131yor ne de aktif<\/strong> Dolay\u0131s\u0131yla burada buna ili\u015fkin bir yasaklama karar\u0131n\u0131n \u00f6nemi yoktur.<\/p>\n\n\n\n<p>Kanun koyucu, tesislerde halihaz\u0131rda \u00e7al\u0131\u015fan ki\u015filer ile 16 Mart 2022 tarihinden itibaren \u00e7al\u0131\u015fmaya ba\u015flayacak ki\u015filer a\u00e7\u0131s\u0131ndan hukuki sonu\u00e7lar\u0131 birbirinden ay\u0131rmaktad\u0131r. <strong>Mevcut \u00e7al\u0131\u015fanlar i\u00e7in, sorumlu sa\u011fl\u0131k otoritesine bir rapor<\/strong> ve sa\u011fl\u0131k bakanl\u0131\u011f\u0131 daha sonra giri\u015f ve faaliyet yasa\u011f\u0131 koyma se\u00e7ene\u011fine sahip olacak, 16 Mart 2022&#039;den itibaren yeni \u00e7al\u0131\u015fanlar\u0131n istihdam edilmesine veya hi\u00e7 \u00e7al\u0131\u015fmas\u0131na izin verilmeyecek.<\/p>\n\n\n\n<p>Peki ger\u00e7ekten \u00f6yle mi?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"besch\u00e4ftigungsverbot_bestandsarbeitnehmer\">Mevcut \u00e7al\u0131\u015fanlara da i\u015f ve faaliyet yasa\u011f\u0131 m\u0131 geliyor?<\/h2>\n\n\n\n<p>Federal Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 bunu a\u00e7\u0131k\u00e7a varsaymaktad\u0131r.<a href=\"https:\/\/www.bundesgesundheitsministerium.de\/fileadmin\/Dateien\/3_Downloads\/C\/Coronavirus\/FAQs_zu_20a_IfSG.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Tesisle ilgili faaliyetlere ili\u015fkin a\u015f\u0131lama \u00f6nleme k\u0131lavuzlar\u0131<\/a>&quot;soruyu yan\u0131tl\u0131yor, <em>&quot;Kan\u0131t sa\u011flanmazsa hangi ad\u0131mlar at\u0131lmal\u0131d\u0131r?&quot;<\/em>Ve burada asl\u0131nda mevcut ve yeni \u00e7al\u0131\u015fanlar aras\u0131nda ayr\u0131m yap\u0131l\u0131yor:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Mevcut \u00e7al\u0131\u015fanlar 15 Mart 2022 tarihine kadar kan\u0131t sunmazsa, y\u00f6netim derhal ilgili sa\u011fl\u0131k otoritesine bildirmelidir. Sa\u011fl\u0131k otoritesi daha sonra vakay\u0131 ara\u015ft\u0131racak ve kan\u0131t talep edecektir. Bir \u00e7al\u0131\u015fan 15 Mart 2022 tarihine kadar kan\u0131t sunmazsa, sa\u011fl\u0131k otoritesi giri\u015f ve \u00e7al\u0131\u015fma yasa\u011f\u0131 koyabilir ve para cezas\u0131 i\u015flemleri ba\u015flatabilir.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Buna kar\u015f\u0131l\u0131k, 16 Mart 2022 tarihinden sonra ilgili tesislerde \u00e7al\u0131\u015fmak isteyen \u00e7al\u0131\u015fanlar istihdam edilmeyebilir veya hi\u00e7 \u00e7al\u0131\u015famazlar.<\/li><\/ul>\n\n\n\n<p>Bunun her \u015feyi a\u00e7\u0131kl\u0131\u011fa kavu\u015fturdu\u011funu d\u00fc\u015f\u00fcnenler yan\u0131l\u0131yor. Bu soru listesi yaln\u0131zca <strong>Federal Bakanl\u0131\u011f\u0131n Enfeksiyon Koruma Yasas\u0131&#039;n\u0131n 20a B\u00f6l\u00fcm\u00fc ile ilgili yorumu<\/strong> Bu yorum, yasa koyucunun amac\u0131n\u0131 yans\u0131tmayabilir ve i\u015f mahkemeleri Federal Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne ba\u011fl\u0131 de\u011fildir. Federal Bakanl\u0131\u011f\u0131n bu k\u0131lavuzu federal h\u00fck\u00fcmet ve eyalet bakanl\u0131klar\u0131yla uzman d\u00fczeyinde koordine etmi\u015f olmas\u0131 bu durumu de\u011fi\u015ftirmez.<\/p>\n\n\n\n<p>As\u0131l sorun \u015fu ki<strong> Enfeksiyon Koruma Yasas\u0131&#039;n\u0131n 20a B\u00f6l\u00fcm\u00fc, Paragraf 3, C\u00fcmle 4 ve 5&#039;inin yan\u0131lt\u0131c\u0131 ifadeleri<\/strong>Bu, \u015fu ki\u015fileri ifade eder: <em>&quot;16 Mart 2022&#039;den itibaren aktif olmal\u0131&quot;<\/em>Sorun \u015fu ki, mevcut \u00e7al\u0131\u015fanlar da 16 Mart 2022&#039;den itibaren \u00e7al\u0131\u015fmak zorunda kalacak. \u00c7al\u0131\u015fma y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmeye devam etmeleri gerekiyor. Madde, 16 Mart 2022 tarihinden itibaren yukar\u0131da belirtilen i\u015fyerlerinde istihdam edilecek ki\u015filere ili\u015fkin usul\u00fc d\u00fczenlemektedir. <strong>yeni<\/strong> istihdam edilmi\u015f<br>16 Mart 2022 tarihinden itibaren yukar\u0131da belirtilen kurum veya \u015firketlerde \u00e7al\u0131\u015fmak isteyen ki\u015filer<br>ger\u00e7ekle\u015ftirilecekse, \u00e7al\u0131\u015fmalar\u0131na ba\u015flamadan \u00f6nce ilgili kurum veya \u015firketin y\u00f6netimine bilgi verilmelidir.<br>Alman Federal Meclisi \u2013 20. Yasama D\u00f6nemi \u2013 41 \u2013 Bas\u0131l\u0131 malzeme 20\/188 faaliyet, a\u015f\u0131 veya iyile\u015fme belgesi, sa\u011fl\u0131k raporunun 2. f\u0131kran\u0131n 1. c\u00fcmlesine uygun olarak ibraz edilmesi gerekmektedir.<\/p><cite>6 Aral\u0131k 2021 tarihli yasa tasar\u0131s\u0131 \u2013 COVID-19&#039;a kar\u015f\u0131 a\u015f\u0131lama \u00f6nlemlerini g\u00fc\u00e7lendirmeye y\u00f6nelik yasa tasar\u0131s\u0131, Bas\u0131l\u0131 materyal 20\/100, B. \u00d6zel B\u00f6l\u00fcm, sayfa 40, B\u00f6l\u00fcm 20a, Paragraf 3 ile ilgili<\/cite><\/blockquote>\n\n\n\n<p>A\u00e7\u0131klay\u0131c\u0131 not, Federal Bakanl\u0131\u011f\u0131n yorumunu a\u00e7\u0131k\u00e7a desteklemektedir. Ayn\u0131 anlay\u0131\u015f\u0131n, <strong>Federal Anayasa Mahkemesi<\/strong> Enfeksiyon Koruma Yasas\u0131&#039;n\u0131n 20a maddesinin ge\u00e7ici hukuki koruma ba\u011flam\u0131nda anayasaya uygunlu\u011fu konusunda bir tutum alm\u0131\u015f olmas\u0131. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Yukar\u0131da belirtilen tesis veya \u015firketlerde 16 Mart 2022 tarihine kadar \u00e7al\u0131\u015fmas\u0131 planlanmayan ki\u015filer, IfSG&#039;nin 20a maddesinin 2. f\u0131kras\u0131n\u0131n 1. c\u00fcmlesi uyar\u0131nca (bkz. IfSG&#039;nin 20a maddesinin 3. f\u0131kras\u0131n\u0131n 1. c\u00fcmlesi) i\u015fe ba\u015flamadan \u00f6nce a\u015f\u0131 olduklar\u0131n\u0131 kan\u0131tlamak zorundad\u0131rlar. Aksi takdirde, bu kurulu\u015flarda istihdam edilemez veya \u00e7al\u0131\u015famazlar (bkz.
