Size hi\u00e7bir y\u00fck\u00fcml\u00fcl\u00fck alt\u0131na girmeden dan\u0131\u015fmanl\u0131k hizmeti verelim.<\/p><a class=\"btn-cta whitespace-nowrap no-outer-space\" href=\"\/tr\/anwalt-aufhebungsvertrag\/\" target=\"_blank\" rel=\"noopener\">Fesih s\u00f6zle\u015fmenizde size nas\u0131l destek oluyoruz?<\/a>\n  <\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-arbeitgeber-erscheint-mit-rechtsanwalt-und-aufhebungsvertrag\">\u0130\u015fveren avukat ve fesih s\u00f6zle\u015fmesiyle haz\u0131r bulunur<\/h2>\n\n\n\n<p>Federal \u0130\u015f Mahkemesi\u2019nin adil m\u00fczakere gereklili\u011fine ili\u015fkin karar\u0131 a\u015fa\u011f\u0131daki davaya dayanmaktad\u0131r:<\/p>\n\n\n\n<p>2019 y\u0131l\u0131n\u0131n sonunda \u015firketin genel m\u00fcd\u00fcr\u00fc, bina hizmetleri departman\u0131ndan bir sat\u0131\u015f ekibi koordinat\u00f6r\u00fcn\u00fc ofisine \u00e7a\u011f\u0131rd\u0131. Ona, kendisine kar\u015f\u0131 su\u00e7lamada bulundu: <strong>Bilgisayar sisteminde haks\u0131z yere sat\u0131n alma fiyatlar\u0131 de\u011fi\u015ftirildi<\/strong>daha y\u00fcksek sat\u0131\u015f k\u00e2r\u0131 yan\u0131lsamas\u0131 yaratmak.<\/p>\n\n\n\n<p>M\u00fclakat s\u0131ras\u0131nda \u00e7al\u0131\u015fan sadece \u015firketin genel m\u00fcd\u00fcr\u00fcyle kar\u015f\u0131 kar\u015f\u0131ya kalmad\u0131. <a href=\"https:\/\/smart-arbeitsrecht.de\/tr\/\"><strong>avukat<\/strong> i\u015f hukuku i\u00e7in<\/a> da oradayd\u0131 \u2013 muhtemelen i\u015fverenin taleplerine hukuki a\u011f\u0131rl\u0131k vermek i\u00e7in.<\/p>\n\n\n\n<p>Genel m\u00fcd\u00fcr \u00e7al\u0131\u015fana bir hediye sundu <strong><a href=\"https:\/\/smart-arbeitsrecht.de\/tr\/aufhebungsvertrag-wertvolle-informationen-fuer-arbeitnehmer\/\">fesih s\u00f6zle\u015fmesi<\/a> hemen imzalanmas\u0131 i\u00e7in<\/strong> 30 Kas\u0131m 2019&#039;a kadar nispeten k\u0131sa bir bildirim s\u00fcresiyle fesih \u00f6ng\u00f6ren bir anla\u015fma. Ekip koordinat\u00f6r\u00fcne bir se\u00e7enek sundu: ya fesih anla\u015fmas\u0131n\u0131 hemen imzalar ya da <strong>ihbars\u0131z ola\u011fan\u00fcst\u00fc fesih<\/strong> bir ile ili\u015fkili <strong>ceza \u015fikayeti<\/strong>.<\/p>\n\n\n\n<p>\u00c7al\u0131\u015fan, fesih s\u00f6zle\u015fmesini de\u011ferlendirmek i\u00e7in s\u00fcre istedi ve bu konuda hukuki dan\u0131\u015fmanl\u0131k almak istedi. Ancak genel m\u00fcd\u00fcr bunu reddetti. Tek se\u00e7ene\u011fi, fesih s\u00f6zle\u015fmesini derhal imzalamakt\u0131. Aksi takdirde, ilan edilen sonu\u00e7lar ge\u00e7erli olacakt\u0131.<\/p>\n\n\n\n<p>Taraflar daha sonra bir <strong>on dakikal\u0131k mola<\/strong> Kar\u015f\u0131l\u0131kl\u0131 sessizce oturdular. Sonunda \u00e7al\u0131\u015fan, fesih s\u00f6zle\u015fmesini imzalayarak i\u015f ili\u015fkisini 30 Kas\u0131m 2019 tarihi itibar\u0131yla sonland\u0131rd\u0131.<\/p>\n\n\n\n<p>K\u0131sa bir s\u00fcre sonra, \u015funu ilan etti: <strong>Hukuka ayk\u0131r\u0131 tehdit nedeniyle s\u00f6zle\u015fmenin feshi<\/strong>Daha sonra i\u015f mahkemesinde i\u015f ili\u015fkisinin devam etti\u011fini ileri s\u00fcrd\u00fc.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Federal \u00c7al\u0131\u015fma Mahkemesi: \u201cAdil m\u00fczakere ilkesi\u201dnin ihlali s\u00f6z konusu de\u011fil<\/h2>\n\n\n\n<p>Alt mahkemeler ba\u015flang\u0131\u00e7ta hukuki durumu farkl\u0131 de\u011ferlendirdi. \u0130\u015f Mahkemesi davay\u0131 kabul ederken, Hamm B\u00f6lge \u0130\u015f Mahkemesi reddetti. \u00c7al\u0131\u015fan\u0131n Federal \u0130\u015f Mahkemesi&#039;ne yapt\u0131\u011f\u0131 itiraz reddedildi.<\/p>\n\n\n\n<p>Federal \u00c7al\u0131\u015fma Mahkemesi ba\u015flang\u0131\u00e7ta <strong>yasa d\u0131\u015f\u0131 bir tehdit yok<\/strong>\u00c7\u00fcnk\u00fc genel m\u00fcd\u00fcr, belirli tehditleri dikkate alma hakk\u0131na sahipti. Makul bir i\u015fveren, b\u00f6yle bir durumda, <a href=\"https:\/\/smart-arbeitsrecht.de\/tr\/kuendigung-des-arbeitsvertrages-kuendigungsschutz\/\">ola\u011fan\u00fcst\u00fc fesih<\/a> ve su\u00e7 duyurusunda bulunmay\u0131 d\u00fc\u015f\u00fcn\u00fcn. Bu nedenle mahkeme, herhangi bir hukuka ayk\u0131r\u0131l\u0131ktan s\u00f6z edilemeyece\u011fine karar verdi.<\/p>\n\n\n\n<div class=\"container p-6 my-5 mx-auto border border-cta\">\n  <div class=\"flex flex-col sm:flex-row sm:items-center items-start mx-auto\">\n    <p class=\"flex-grow sm:pr-16 text-2xl font-medium title-font text-gray-500 sm:no-outer-space\">Fesih yak\u0131nsa veya zaten ilan edilmi\u015fse deste\u011fimize g\u00fcvenebilirsiniz.<\/p><a class=\"btn-cta whitespace-nowrap no-outer-space\" href=\"\/tr\/anwalt-kuendigung-arbeitsrecht\/\" target=\"_blank\" rel=\"noopener\">Fesih durumunda size sundu\u011fumuz hizmetler<\/a>\n  <\/div>\n<\/div>\n\n\n\n<p>\u0130\u015fveren, \u00e7al\u0131\u015fana s\u00f6zle\u015fmeyi reddederek adil m\u00fczakere ilkesini de ihlal etmemi\u015ftir. <strong>Hukuki tavsiye almak<\/strong> reddedildi. Dolay\u0131s\u0131yla i\u015fveren bu emri ihlal etmemi\u015ftir. <\/p>\n\n\n\n<p>Y\u00f6netici m\u00fcd\u00fcr\u00fcn \u00e7al\u0131\u015fana yaln\u0131zca <strong>Teklifin hemen kabul edilme olas\u0131l\u0131\u011f\u0131<\/strong> fesih s\u00f6zle\u015fmesi yapmak, k<strong>adil m\u00fczakere ilkesinin ihlali<\/strong>Bu ba\u011flamda da, kendisinin yasal y\u00fck\u00fcml\u00fcl\u00fcklerinin ihlali s\u00f6z konusuydu. <a href=\"https:\/\/www.gesetze-im-internet.de\/bgb\/__311.html\" target=\"_blank\" rel=\"noreferrer noopener\">B\u00f6l\u00fcm 311 paragraf 2 no. 1 BGB<\/a> ile birle\u015ftirilmi\u015f <a href=\"https:\/\/www.gesetze-im-internet.de\/bgb\/__241.html\" target=\"_blank\" rel=\"noreferrer noopener\">Alman Medeni Kanunu&#039;nun 241. maddesinin 2. f\u0131kras\u0131<\/a> verilmemi\u015ftir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Adil m\u00fczakere ilkesi asl\u0131nda ne anlama geliyor?<\/h2>\n\n\n\n<p>Federal \u0130\u015f Mahkemesi&#039;nin karar\u0131, \u00f6nceki kararlarla uyumludur. Adil m\u00fczakere gereklili\u011fine ili\u015fkin \u00e7\u0131\u011f\u0131r a\u00e7\u0131c\u0131 karar 2019 y\u0131l\u0131nda verilmi\u015fti. O d\u00f6nemde mahkeme, fesih m\u00fczakereleri ba\u011flam\u0131nda, <strong>haks\u0131z pazarl\u0131k durumlar\u0131 yok<\/strong> yarat\u0131labilir.<\/p>\n\n\n\n<p>Adil m\u00fczakere ilkesi, ger\u00e7ek irade eksikli\u011fi e\u015fi\u011finin alt\u0131nda olan \u00e7al\u0131\u015fanlar\u0131 korumay\u0131 ama\u00e7lamaktad\u0131r. <strong>S\u00f6zle\u015fme m\u00fczakerelerinde karar \u00f6zg\u00fcrl\u00fc\u011f\u00fc<\/strong>.<\/p>\n\n\n\n<p>Bir durum, a\u015fa\u011f\u0131daki durumlarda haks\u0131z kabul edilir: <strong>psikolojik bask\u0131 durumu<\/strong> s\u00f6zle\u015fme taraf\u0131n\u0131n \u00f6zg\u00fcr ve d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015f bir karar almas\u0131n\u0131 \u00f6nemli \u00f6l\u00e7\u00fcde zorla\u015ft\u0131racak veya hatta imk\u00e2ns\u0131z k\u0131lacak \u015fekilde yarat\u0131l\u0131r veya kullan\u0131l\u0131r.<\/p>\n\n\n\n<p>Bunlara \u00f6rnek olarak \u015funlar dahildir: <strong>Nesnel olarak tan\u0131nabilir fiziksel veya psikolojik bir zay\u0131fl\u0131\u011f\u0131n istismar edilmesi<\/strong> veya yetersiz <strong>Dil becerileri<\/strong>Birinin kullan\u0131m\u0131 <strong>s\u00fcrpriz an\u0131<\/strong> (\u00c7al\u0131\u015fan\u0131n evinde ziyaret edilmesi) haks\u0131z muamele te\u015fkil edebilir.<\/p>\n\n\n\n<p>Ancak bu sadece bir <strong>Asgari d\u00fczeyde adalet<\/strong>Bu nedenle, e\u011fer adil m\u00fczakere ilkesinin ihlali s\u00f6z konusu de\u011filse,<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fesih s\u00f6zle\u015fmesinin akdedilmesine ili\u015fkin teklifin kabul\u00fc ancak derhal m\u00fcmk\u00fcn olup, \u00e7al\u0131\u015fan\u0131n bunu de\u011ferlendirmeye vaktinin olmamas\u0131,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00e7al\u0131\u015fana herhangi bir geri \u00e7ekilme veya fesih hakk\u0131 tan\u0131nmam\u0131\u015fsa veya<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130mzalamadan \u00f6nce hukuki dan\u0131\u015fmanl\u0131k alma imk\u00e2n\u0131 yoktur.<\/li>\n<\/ul>\n\n\n\n<p>Ama\u00e7, \u00e7al\u0131\u015fanlar i\u00e7in \u00f6zellikle keyifli bir m\u00fczakere ortam\u0131 yaratmak de\u011fil. As\u0131l mesele, s\u00f6zle\u015fme imzalanmadan \u00f6nce &quot;sadece&quot; asgari d\u00fczeyde bir adalet sa\u011flamak.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.bundesarbeitsgericht.de\/entscheidung\/6-azr-75-18\/#:~:text=Leitsatz-,1.,fairen%20Verhandelns%20zustande%20gekommen%20ist.\" target=\"_blank\" rel=\"noreferrer noopener\">Federal \u00c7al\u0131\u015fma Mahkemesi&#039;nin 7 \u015eubat 2019 tarihli karar\u0131 \u2013 6 AZR 75\/18<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">BAG karar\u0131n\u0131n adil m\u00fczakere gereklili\u011fine ili\u015fkin s\u0131n\u0131fland\u0131rmas\u0131<\/h2>\n\n\n\n<p>Federal \u0130\u015f Mahkemesi, bu davada adil m\u00fczakere ilkesinin ihlal edilmedi\u011fine dair do\u011fru bir karar m\u0131 verdi? Bu konuda \u015f\u00fcphe uyand\u0131ran iki neden var. <\/p>\n\n\n\n<p>Birincisi, \u00e7al\u0131\u015fan sadece genel m\u00fcd\u00fcr\u00fcn kar\u015f\u0131s\u0131nda oturmuyordu, ayn\u0131 zamanda <strong>\u0130\u015f hukuku avukat\u0131<\/strong>Bu, \u00e7al\u0131\u015fan\u0131n kendi sorumlulu\u011funda olmal\u0131d\u0131r <strong>ek bas\u0131n\u00e7<\/strong> ve fesih s\u00f6zle\u015fmesinin imzalanmas\u0131n\u0131n \u00f6nemini vurgulad\u0131. Fesih s\u00f6zle\u015fmesi ba\u011flam\u0131nda bunun neden farkl\u0131 olmas\u0131 gerekti\u011fi ilk bak\u0131\u015fta a\u00e7\u0131k olmayabilir. <strong>Se\u00e7im \u00f6zg\u00fcrl\u00fc\u011f\u00fc<\/strong> \u00f6zellikle hakim olan bas\u0131n\u00e7 nedeniyle bu gibi durumlarda d\u00fczenli olarak en az\u0131ndan d\u00fc\u015f\u00fcr\u00fcl\u00fcr.<\/p>\n\n\n\n<p>Ayr\u0131ca \u00e7al\u0131\u015fanlar fesih s\u00f6zle\u015fmesini yaln\u0131zca imzalayabilirler <strong>hemen imzala<\/strong> Bu durum onun \u00fczerindeki bask\u0131y\u0131 art\u0131rm\u0131\u015f ve se\u00e7im \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc \u00f6nemli \u00f6l\u00e7\u00fcde k\u0131s\u0131tlam\u0131\u015f olabilir.<\/p>\n\n\n\n<p>Ancak her bask\u0131 durumu otomatik olarak b\u00f6ylesine adaletsiz bir m\u00fczakere durumuna yol a\u00e7maz. Bu t\u00fcr durumlarda \u00e7al\u0131\u015fanlar her zaman etkilenir ve sonu\u00e7 da olumsuz olur. <strong>Adil m\u00fczakere ilkesinin ihlali yaln\u0131zca istisnai durumlarda m\u00fcmk\u00fcnd\u00fcr<\/strong> Burada \u00e7\u0131karlar taban tabana z\u0131tt\u0131r ve as\u0131l soru, bu gibi durumlarda i\u015fverenden ne d\u00fczeyde adalet beklendi\u011fidir.<\/p>\n\n\n\n<p><strong>Benim bak\u0131\u015f a\u00e7\u0131ma g\u00f6re <\/strong>B\u00f6yle bir istisna burada ge\u00e7erli de\u011fildi. \u00c7al\u0131\u015fanlar, sadece &quot;hay\u0131r&quot; diyerek bu durumdan ka\u00e7\u0131nabilirlerdi.
