Ama\u00e7, enfeksiyon riskini en aza indirmek, \u00e7al\u0131\u015fanlar\u0131 korumak ve nihayetinde isteklerini yerine getirmekti.<\/p>\n\n\n\n<p>Ancak davac\u0131, <strong>koronavir\u00fcse kar\u015f\u0131 a\u015f\u0131 yok<\/strong> ve o da iyile\u015fmemi\u015fti. \u0130\u015fverenine teklifte bulundu <strong>g\u00fcnl\u00fck test sertifikalar\u0131<\/strong> Koronavir\u00fcse yakalanmad\u0131\u011f\u0131n\u0131 kan\u0131tlamak i\u00e7in i\u015fveren, \u00e7al\u0131\u015fan\u0131n \u00f6nerisini kabul etmemi\u015f ve deneme s\u00fcresi i\u00e7inde i\u015f akdini feshetmi\u015ftir.<\/p>\n\n\n\n<p>Davac\u0131 i\u015ften \u00e7\u0131karma karar\u0131na kar\u015f\u0131 temyiz ba\u015fvurusunda bulundu <strong><a href=\"https:\/\/smart-arbeitsrecht.de\/tr\/kuendigung-des-arbeitsvertrages-kuendigungsschutz\/#k%C3%BCndigungsschutzklage\">\u0130\u015ften \u00e7\u0131kar\u0131lma koruma davas\u0131<\/a><\/strong> i\u015f mahkemesinde.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Berlin \u0130\u015f Mahkemesi i\u015ften \u00e7\u0131karmay\u0131 hakl\u0131 buldu<\/h2>\n\n\n\n<p><a href=\"https:\/\/gesetze.berlin.de\/bsbe\/document\/JURE220023895\" target=\"_blank\" rel=\"noreferrer noopener\">Berlin \u0130\u015f Mahkemesi karar verdi<\/a>ki <strong>\u0130\u015fverenin deneme s\u00fcresini sona erdirmesi yasald\u0131r<\/strong> \u0130\u015fveren, i\u015f s\u00f6zle\u015fmesini ihlal etmemi\u015ftir. <a href=\"https:\/\/smart-arbeitsrecht.de\/tr\/kuendigung-des-arbeitsvertrages-kuendigungsschutz\/#arten_k%C3%BCndigungsschutz\">Disiplin cezas\u0131n\u0131n yasaklanmas\u0131<\/a> d\u0131\u015f\u0131nda <a href=\"https:\/\/www.gesetze-im-internet.de\/bgb\/__612a.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 612a Alman Medeni Kanunu<\/a> Davac\u0131n\u0131n a\u015f\u0131 yapt\u0131rmamas\u0131 nedeniyle i\u015ften \u00e7\u0131kar\u0131lma karar\u0131 vererek.<\/p>\n\n\n\n<p>Alman Medeni Kanunu&#039;nun (BGB) 612a maddesine g\u00f6re, bir i\u015fveren, \u00e7al\u0131\u015fan\u0131n haklar\u0131n\u0131 izin verilen \u015fekilde kullanmas\u0131 nedeniyle bir s\u00f6zle\u015fme veya tedbirle \u00e7al\u0131\u015fana kar\u015f\u0131 ayr\u0131mc\u0131l\u0131k yapamaz (<strong>Disiplin cezas\u0131n\u0131n yasaklanmas\u0131<\/strong>Mahkeme, \u00f6ncelikle temel haklar\u0131n kullan\u0131lmas\u0131n\u0131n bu h\u00fck\u00fcm anlam\u0131nda bir hak kullan\u0131m\u0131 olarak kabul edilmesi gerekti\u011fini vurgulam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Davac\u0131 ayr\u0131ca, i\u015fverenine a\u015f\u0131 yapt\u0131rmadan \u00e7al\u0131\u015fmak istedi\u011fini beyan ederek temel haklar\u0131n\u0131 kullanm\u0131\u015ft\u0131r. Davac\u0131 b\u00f6ylece, <strong>Genel ki\u015fisel haklar<\/strong> sonras\u0131nda <a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_2.html\" target=\"_blank\" rel=\"noreferrer noopener\">GG Madde 2 F\u0131kra 1 <\/a>ile birlikte <a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_1.html\" target=\"_blank\" rel=\"noreferrer noopener\">Madde 1, f\u0131kra 1 GG<\/a> ve onlar\u0131n yan\u0131 s\u0131ra <strong>Fiziksel b\u00fct\u00fcnl\u00fc\u011fe sayg\u0131 hakk\u0131<\/strong> Anayasa&#039;n\u0131n 2. maddesinin 2. f\u0131kras\u0131 uyar\u0131nca. Ancak mahkeme, i\u015fverenin bu gerek\u00e7eyle kendisine kar\u015f\u0131 ayr\u0131mc\u0131l\u0131k yapmad\u0131\u011f\u0131na h\u00fckmetti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ayr\u0131mc\u0131l\u0131k yok - 2G modeli i\u015ften \u00e7\u0131kar\u0131lmaya neden oldu<\/h2>\n\n\n\n<p>Bir eksiklik var <strong>Haklar\u0131n kullan\u0131m\u0131 ile ayr\u0131mc\u0131l\u0131k aras\u0131ndaki nedensellik<\/strong>, \u00e7\u00fcnk\u00fc davac\u0131lar\u0131n haklar\u0131n\u0131 kullanmas\u0131, i\u015f akdinin feshedilmesi karar\u0131n\u0131n temel nedeni de\u011fildi. Karar, \u015f\u00fcphesiz i\u015fverenlerin koronavir\u00fcsle ilgili i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerini uygulama konusundaki giri\u015fimcilik \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc g\u00fc\u00e7lendiriyor.
