Buna ra\u011fmen, Hukuk Y\u00fcksek Lisans derecesine ve iki \u00fcniversitede kapsaml\u0131 \u00fcst d\u00fczey kamu hizmeti deneyimine sahip interseks bir ki\u015fi ba\u015fvuruda bulundu ve m\u00fclakata davet edildi, ancak pozisyon kendisine teklif edilmedi.<\/p>\n\n\n\n<p>Ba\u015fvurucu daha sonra, yaln\u0131zca kad\u0131nlara y\u00f6nelik olan i\u015f ilan\u0131 nedeniyle ayr\u0131mc\u0131l\u0131k yap\u0131ld\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek cinsiyet ayr\u0131mc\u0131l\u0131\u011f\u0131 nedeniyle 7.000 avro tazminat davas\u0131 a\u00e7t\u0131.<\/p>\n\n\n\n<p>\u0130\u015f mahkemesi ba\u015flang\u0131\u00e7ta kendisine 3.500 Avro (talep edilen miktar\u0131n yar\u0131s\u0131) tazminat \u00f6denmesine karar verdi ve eyalet i\u015f mahkemesi de bu karar\u0131 onad\u0131. B\u00f6lgenin, reddin cinsiyete dayal\u0131 olmad\u0131\u011f\u0131n\u0131 ikna edici bir \u015fekilde kan\u0131tlayamad\u0131\u011f\u0131na h\u00fckmetti. Ayr\u0131ca mahkeme, interseks bireylerin bu pozisyondan temelden d\u0131\u015flanmas\u0131 i\u00e7in yeterli ve nesnel bir sebep bulamad\u0131.<\/p>\n\n\n\n<p>Ancak Federal \u0130\u015f Mahkemesi (BAG), Ekim 2024&#039;te farkl\u0131 bir sonuca vararak (17 Ekim 2024 tarihli karar \u2013 8 AZR 214\/23) davay\u0131 tamamen reddetti. Cinsiyet ayr\u0131mc\u0131l\u0131\u011f\u0131 mevcut olsa da, Genel E\u015fit Muamele Yasas\u0131&#039;n\u0131n (AGG) 8 (1) Maddesi uyar\u0131nca izin verilebilirdi. Pozisyonun yaln\u0131zca kad\u0131nlara y\u00f6nelik olmas\u0131, kad\u0131nlar\u0131n kamu hizmetinde \u00f6zel olarak terfi ettirilmesini \u00f6ng\u00f6ren anayasal zorunlulukla hakl\u0131yd\u0131. Bu nedenle, AGG&#039;nin 15 (2) Maddesi uyar\u0131nca tazminat talebi s\u00f6z konusu de\u011fildi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\"><strong><strong>Mesleki bir gereklilik olarak kad\u0131n olmak: Federal \u00c7al\u0131\u015fma Mahkemesi, kad\u0131n e\u015fit f\u0131rsat memurlar\u0131na y\u00f6nelik k\u0131s\u0131tlamay\u0131 onaylad\u0131<\/strong><\/strong><\/h2>\n\n\n\n<p>Federal \u00c7al\u0131\u015fma Mahkemesi (BAG), Schleswig-Holstein&#039;da e\u015fit f\u0131rsat g\u00f6revlisi pozisyonunun yaln\u0131zca kad\u0131nlarla doldurulmas\u0131 y\u00f6n\u00fcndeki yasal zorunlulu\u011fun yasal oldu\u011funa karar verdi.<\/p>\n\n\n\n<p>Mahkeme, kad\u0131n cinsiyetinin, \u00f6zellikle cinsel taciz gibi stresli durumlarda kad\u0131nlara dan\u0131\u015fmanl\u0131k yapma konusunda temel ve uygun bir mesleki gereklilik oldu\u011funu a\u00e7\u0131kl\u0131\u011fa kavu\u015fturdu. Deneyimler, etkilenenlerin kad\u0131n bir irtibat ki\u015fisine a\u00e7\u0131lma olas\u0131l\u0131\u011f\u0131n\u0131n daha y\u00fcksek oldu\u011funu g\u00f6stermi\u015ftir.<\/p>\n\n\n\n<p>Bu k\u0131s\u0131tlama sadece erkekler i\u00e7in de\u011fil, ayn\u0131 zamanda interseks bireyler i\u00e7in de ge\u00e7erlidir. \u0130kili cinsiyete sahip bireyler de ayr\u0131mc\u0131l\u0131\u011fa maruz kalabilse de, bu durum onlar\u0131n kad\u0131n olarak rollerini a\u00e7\u0131k\u00e7a etkilemez.
