Karar, i\u015fverenlerin tarafs\u0131zl\u0131k \u015fartlar\u0131n\u0131, objektif bir gerek\u00e7e olmaks\u0131z\u0131n dini ifadeyi yasaklamak i\u00e7in kullanamayacaklar\u0131n\u0131 vurgulamaktad\u0131r.<\/p>\n\n\n\n<p>Karar, dini k\u0131yafetlere dayal\u0131 ayr\u0131mc\u0131l\u0131k konusunda verilen \u00f6nemli kararlar dizisinin bir par\u00e7as\u0131 olup, i\u015f hukukunda s\u00f6zle\u015fme haz\u0131rlaman\u0131n ne kadar hassas olmas\u0131 gerekti\u011fini a\u00e7\u0131k\u00e7a ortaya koymaktad\u0131r.<\/p>\n\n\n\n<p>AGG&#039;nin etkilenenleri nas\u0131l korudu\u011funu ve dini nedenlerle ayr\u0131mc\u0131l\u0131k yap\u0131ld\u0131\u011f\u0131nda hangi yasal standartlar\u0131n ge\u00e7erli oldu\u011funu buradan \u00f6\u011frenin.<\/p>\n\n\n\n<div class=\"toc\">\n<h2>Sizi neler bekliyor:<\/h2>\n<ol>\n<li><a href=\"#1\">Tarafs\u0131zl\u0131k \u015fart\u0131 ayr\u0131mc\u0131l\u0131kt\u0131r: LAG Berlin-Brandenburg tazminat \u00f6d\u00fcyor\n<\/a><\/li>\n<li><a href=\"#2\">\u0130\u015f s\u00f6zle\u015fmesindeki tarafs\u0131zl\u0131k \u015fart\u0131n\u0131n neden kabul edilemez oldu\u011fu\n<\/a><\/li>\n<li><a href=\"#3\">Mahkeme ayr\u0131mc\u0131l\u0131\u011f\u0131 do\u011frulad\u0131: Ba\u015f\u00f6rt\u00fcs\u00fc yasa\u011f\u0131 temel haklar\u0131 ihlal ediyor\n<\/a><\/li>\n<li><a href=\"#4\">LAG Berlin-Brandenburg: Ba\u015f\u00f6rt\u00fcs\u00fc yasa\u011f\u0131 orant\u0131s\u0131z\n<\/a><\/li>\n<\/ol>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"1\">Tarafs\u0131zl\u0131k \u015fart\u0131 ayr\u0131mc\u0131l\u0131kt\u0131r: LAG Berlin-Brandenburg tazminat \u00f6d\u00fcyor<\/h2>\n\n\n\n<p>Berlin-Brandenburg Eyalet \u0130\u015f Mahkemesi (LAG), 12 Kas\u0131m 2024 tarihli karar\u0131nda (dava no. 11 Sa 443\/24), M\u00fcsl\u00fcman bir ba\u015fvurucuya tarafs\u0131zl\u0131k maddesi i\u00e7eren bir i\u015f s\u00f6zle\u015fmesi sunulmas\u0131n\u0131n Genel E\u015fit Muamele Yasas\u0131&#039;n\u0131 (AGG) ihlal etti\u011fine karar verdi. Davac\u0131, bir sosyal yard\u0131m kurulu\u015funda \u00f6\u011frenci \u00e7al\u0131\u015fan\u0131 olarak bir pozisyon i\u00e7in ba\u015fvuruda bulunmu\u015ftu. \u0130\u015fi, m\u00fc\u015fteriyle hi\u00e7bir temas\u0131 olmayacak \u015fekilde yaln\u0131zca ara\u015ft\u0131rma \u00e7al\u0131\u015fmalar\u0131ndan olu\u015facakt\u0131. Ancak i\u015f s\u00f6zle\u015fmesinde, g\u00f6r\u00fcn\u00fcr dini sembollerin tak\u0131lmas\u0131n\u0131 yasaklayan bir madde bulunuyordu. \u0130\u015fveren bunu, olas\u0131 i\u00e7 \u00e7at\u0131\u015fmalarla gerek\u00e7elendirdi.<\/p>\n\n\n\n<p>Mahkeme, bunu dine dayal\u0131 hukuka ayk\u0131r\u0131 bir ayr\u0131mc\u0131l\u0131k olarak de\u011ferlendirdi. Ba\u015f\u00f6rt\u00fcs\u00fcn\u00fcn i\u015f g\u00f6revleriyle hi\u00e7bir ba\u011flant\u0131s\u0131 olmad\u0131\u011f\u0131 i\u00e7in davac\u0131ya iki ayl\u0131k maa\u015f tutar\u0131nda tazminat \u00f6denmesine karar verildi. Berlin \u0130\u015f Mahkemesi daha \u00f6nce davay\u0131 reddetmi\u015fti (18 Nisan 2023 tarihli karar, dava numaras\u0131 38 Ca 5915\/23). Y\u00fcksek \u0130\u015f Mahkemesi karar\u0131nda, tarafs\u0131zl\u0131k \u015fart\u0131n\u0131n Genel E\u015fit Muamele Yasas\u0131&#039;n\u0131n (AGG) 7. maddesini ihlal etti\u011fini ve davac\u0131n\u0131n ba\u015f\u00f6rt\u00fcs\u00fc nedeniyle maruz kald\u0131\u011f\u0131 ayr\u0131mc\u0131l\u0131\u011f\u0131n objektif gerek\u00e7elerle hakl\u0131 g\u00f6sterilemedi\u011fini a\u00e7\u0131kl\u0131\u011fa kavu\u015fturdu.<\/p>\n\n\n\n<p>Mahkeme, gerek\u00e7esinde Federal \u0130\u015f Mahkemesi&#039;nin (BAG, 27 A\u011fustos 2020 tarihli karar, dava no. 8 AZR 62\/19) ve Avrupa Adalet Divan\u0131&#039;n\u0131n (ECJ, 13 Ekim 2022 tarihli karar, dava no. C-344\/20) \u00e7\u0131\u011f\u0131r a\u00e7\u0131c\u0131 kararlar\u0131na da at\u0131fta bulunmu\u015ftur. Bu kararlar, hem do\u011frudan hem de dolayl\u0131 ayr\u0131mc\u0131l\u0131\u011f\u0131n, \u00f6zellikle de dini \u00f6zelliklerin i\u015fe \u00f6zel bir at\u0131f yap\u0131lmadan k\u0131s\u0131tland\u0131\u011f\u0131 durumlarda, meydana gelebilece\u011fini teyit etmektedir. LAG, tarafs\u0131zl\u0131k \u015fart\u0131n\u0131n \u00f6\u011frenci i\u015f\u00e7inin faaliyeti i\u00e7in gerekli olmad\u0131\u011f\u0131 ve bu nedenle izin verilemez bir ayr\u0131mc\u0131l\u0131k te\u015fkil etti\u011fi sonucuna varm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>\u0130\u015fyerinde ayr\u0131mc\u0131l\u0131\u011f\u0131n kan\u0131tlanmas\u0131 genellikle zordur; ancak yasalarca yasakt\u0131r. \u0130\u015f hukuku alan\u0131nda uzmanla\u015fm\u0131\u015f avukatlar\u0131m\u0131z, haklar\u0131n\u0131z\u0131 savunman\u0131zda size uzman deste\u011fi sa\u011flayacakt\u0131r. Genel E\u015fit Muamele Yasas\u0131 (AGG) kapsam\u0131ndaki ayr\u0131mc\u0131l\u0131k davalar\u0131n\u0131 inceliyor, olas\u0131 davalar konusunda dan\u0131\u015fmanl\u0131k yap\u0131yor ve tazminat taleplerini kararl\u0131l\u0131kla y\u00fcr\u00fct\u00fcyoruz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\">\u0130\u015f s\u00f6zle\u015fmesindeki tarafs\u0131zl\u0131k \u015fart\u0131n\u0131n neden kabul edilemez oldu\u011fu<\/h2>\n\n\n\n<p>Davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesinde, g\u00f6r\u00fcn\u00fcr dini sembollerin tak\u0131lmas\u0131n\u0131 yasaklayan bir madde yer al\u0131yordu. \u0130\u015fveren, ba\u015fvurucunun ba\u015f\u00f6rt\u00fcs\u00fc takmamas\u0131 halinde i\u015fe al\u0131nmas\u0131n\u0131n m\u00fcmk\u00fcn olaca\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a belirtmi\u015fti.<\/p>\n\n\n\n<p>Berlin-Brandenburg Eyalet \u0130\u015f Mahkemesi (LAG), bu ko\u015fulun kabul edilemez oldu\u011funa karar verdi. \u00d6\u011frenci \u00e7al\u0131\u015fan\u0131n faaliyeti ara\u015ft\u0131rmayla s\u0131n\u0131rl\u0131yd\u0131 ve herhangi bir d\u0131\u015f tarafs\u0131zl\u0131k gerektirmiyordu. Mahkeme a\u00e7\u0131k\u00e7a \u015f\u00f6yle demi\u015fti: &quot;Bu faaliyetin usul\u00fcne uygun \u015fekilde yerine getirilmesi, \u00e7al\u0131\u015fan\u0131n \u0130slami ba\u015f\u00f6rt\u00fcs\u00fc tak\u0131p takmamas\u0131na ba\u011fl\u0131 de\u011fildir.&quot; Dolay\u0131s\u0131yla tarafs\u0131zl\u0131k h\u00fckm\u00fc, davac\u0131n\u0131n din \u00f6zg\u00fcrl\u00fc\u011f\u00fcne haks\u0131z bir m\u00fcdahalede bulunmu\u015f ve Genel E\u015fit Muamele Yasas\u0131&#039;n\u0131 (AGG) ihlal etmi\u015ftir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3\">Mahkeme ayr\u0131mc\u0131l\u0131\u011f\u0131 do\u011frulad\u0131: Ba\u015f\u00f6rt\u00fcs\u00fc yasa\u011f\u0131 temel haklar\u0131 ihlal ediyor<\/h2>\n\n\n\n<p>Berlin-Brandenburg Eyalet \u0130\u015f Mahkemesi (LAG), karar\u0131nda ba\u015f\u00f6rt\u00fcs\u00fc yasaklar\u0131na ili\u015fkin yerle\u015fik i\u00e7tihatlara bir kez daha at\u0131fta bulundu. Mahkeme, i\u015f yerinde dini k\u0131yafetlerin tamamen yasaklanmas\u0131na ancak s\u0131k\u0131 ko\u015fullar alt\u0131nda izin verildi\u011fini, aksi takdirde inan\u00e7 ve din \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn temel hakk\u0131n\u0131 ihlal etti\u011fini (Temel Kanun&#039;un 4. maddesinin 1. ve 2. f\u0131kralar\u0131) a\u00e7\u0131k\u00e7a belirtti.<\/p>\n\n\n\n<p>Federal Anayasa Mahkemesi (BVerfG), ba\u015f\u00f6rt\u00fcs\u00fc yasa\u011f\u0131n\u0131n, \u00f6rne\u011fin \u00f6\u011fretmenler (BVerfG, 27 Ocak 2015 tarihli karar, dava no. 1 BvR 471\/10) veya anaokulu \u00f6\u011fretmenleri (BVerfG, 18 Ekim 2016 tarihli karar, dava no. 1 BvR 354\/11) i\u00e7in kabul edilemez oldu\u011funu daha \u00f6nce a\u00e7\u0131k\u00e7a belirtmi\u015fti.<\/p>\n\n\n\n<p>Federal \u0130\u015f Mahkemesi (BAG), ba\u015f\u00f6rt\u00fcs\u00fc takman\u0131n yol a\u00e7t\u0131\u011f\u0131 somut i\u015fleyi\u015f aksakl\u0131klar\u0131n\u0131n ispatlanmas\u0131 halinde tarafs\u0131zl\u0131k \u015fart\u0131n\u0131n hukuka uygun oldu\u011funu teyit etmi\u015ftir (BAG, 27 A\u011fustos 2020 tarihli karar, dava numaras\u0131 8 AZR 62\/19).<\/p>\n\n\n\n<p>Avrupa Adalet Divan\u0131 (ABAD) da gerekliliklerini \u015f\u00f6yle s\u0131ralad\u0131: Ba\u015f\u00f6rt\u00fcs\u00fc yasa\u011f\u0131 me\u015fru bir amaca hizmet etmeli, orant\u0131l\u0131 olmal\u0131 ve Almanya&#039;da garanti alt\u0131na al\u0131nan din \u00f6zg\u00fcrl\u00fc\u011f\u00fc gibi ulusal temel hak standartlar\u0131n\u0131 dikkate almal\u0131d\u0131r (ABAD, 13 Ekim 2022 tarihli karar, dava no. C-344\/20; ABAD, 15 Temmuz 2021 tarihli karar, dava no. C-804\/18 ve C-341\/19).<\/p>\n\n\n\n<p>LAG&#039;nin karar\u0131, istihdam ili\u015fkilerinde tarafs\u0131zl\u0131k gerekliliklerine ili\u015fkin a\u00e7\u0131k s\u0131n\u0131rlar koyan yerle\u015fik i\u00e7tihatlarla uyumludur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4\">LAG Berlin-Brandenburg: Ba\u015f\u00f6rt\u00fcs\u00fc yasa\u011f\u0131 orant\u0131s\u0131z<\/h2>\n\n\n\n<p>Berlin-Brandenburg B\u00f6lge \u0130\u015f Mahkemesi (LAG) karara ba\u011flanan davada \u015fu ifadelere yer verdi: Tarafs\u0131zl\u0131k maddesi kapsam\u0131nda ba\u015f\u00f6rt\u00fcs\u00fcn\u00fcn tamamen yasaklanmas\u0131 orant\u0131s\u0131zd\u0131r ve Genel E\u015fit Muamele Yasas\u0131 (AGG) anlam\u0131nda ayr\u0131mc\u0131l\u0131k te\u015fkil etmektedir.<\/p>\n\n\n\n<p>\u0130\u015fyerinde ayr\u0131mc\u0131l\u0131\u011fa maruz kald\u0131\u011f\u0131n\u0131zdan m\u0131 \u015f\u00fcpheleniyorsunuz? \u0130\u015f hukuku hizmetlerimiz, sa\u011flam de\u011ferlendirmeler, hukuken ge\u00e7erli arg\u00fcmanlar ve adil \u00e7al\u0131\u015fma ko\u015fullar\u0131 hedefiyle haklar\u0131n\u0131z\u0131 savunman\u0131za yard\u0131mc\u0131 olacakt\u0131r.
