Hemen \u00fccretsiz bir ilk de\u011ferlendirme al\u0131n; haklar\u0131n\u0131z\u0131 koruyaca\u011f\u0131z.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\">\u0130\u015ften \u00e7\u0131kar\u0131lmaya kar\u015f\u0131 koruma ve sosyal gerek\u00e7elendirme \u2013 Bir i\u015ften \u00e7\u0131karman\u0131n etkisiz olabilece\u011fi durumlar<\/h2>\n\n\n\n<p>Almanya&#039;da fesih bildiriminde bir sebep bulunmas\u0131 zorunlu olmasa da, her feshin hukuken ge\u00e7erli oldu\u011fu anlam\u0131na gelmez.<\/p>\n\n\n\n<p>\u0130\u015ften \u00c7\u0131karma Koruma Yasas\u0131 (KSchG), \u00e7al\u0131\u015fanlar\u0131 haks\u0131z yere i\u015ften \u00e7\u0131karmaya kar\u015f\u0131 korur; ancak bunun i\u00e7in i\u015f ili\u015fkisinin alt\u0131 aydan uzun s\u00fcrmesi ve i\u015fverenin d\u00fczenli olarak ondan fazla \u00e7al\u0131\u015fan\u0131 istihdam etmesi gerekir.<\/p>\n\n\n\n<p>Bu durumlarda, i\u015ften \u00e7\u0131karma yaln\u0131zca sosyal a\u00e7\u0131dan hakl\u0131 gerek\u00e7elere dayan\u0131yorsa m\u00fcmk\u00fcnd\u00fcr. \u0130\u015fveren, a\u015fa\u011f\u0131daki sebeplerden birinin ge\u00e7erli oldu\u011funa dair makul kan\u0131t sunmal\u0131d\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Operasyonel nedenlerle i\u015ften \u00e7\u0131karma: \u00f6rne\u011fin i\u015ften \u00e7\u0131karmalar, yeniden yap\u0131land\u0131rma veya g\u00f6rev de\u011fi\u015fikli\u011fi nedeniyle<\/li>\n\n\n\n<li>Ki\u015fisel nedenlerle i\u015ften \u00e7\u0131kar\u0131lma: \u00f6rne\u011fin, kal\u0131c\u0131 hastal\u0131k veya nitelik eksikli\u011fi durumunda<\/li>\n\n\n\n<li>Uygunsuz davran\u0131\u015f nedeniyle i\u015ften \u00e7\u0131karma: Tekrarlanan uygunsuz davran\u0131\u015f veya s\u00f6zle\u015fmesel y\u00fck\u00fcml\u00fcl\u00fcklerin ihlali durumunda<\/li>\n<\/ul>\n\n\n\n<p>B\u00f6yle bir fesih sebebinin bulunmamas\u0131 veya gerek\u00e7enin yetersiz olmas\u0131 halinde fesih ge\u00e7ersiz olabilir.<\/p>\n\n\n\n<p>\u0130\u015f hukuku avukatlar\u0131m\u0131z, i\u015ften \u00e7\u0131kar\u0131lman\u0131z\u0131n sosyal a\u00e7\u0131dan hakl\u0131 olup olmad\u0131\u011f\u0131n\u0131 titizlikle inceleyecek ve haks\u0131z fesih davalar\u0131nda, k\u0131dem tazminat\u0131 m\u00fczakerelerinde veya i\u015fe devam etmeyle ilgili anla\u015fmazl\u0131klarda sizi temsil edecektir. \u00dccretsiz ilk de\u011ferlendirmenizi hemen al\u0131n; haklar\u0131n\u0131z i\u00e7in m\u00fccadele edece\u011fiz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3\">Ola\u011fan\u00fcst\u00fc (derhal) fesih \u2013 \u0130\u015fverenlerin ve \u00e7al\u0131\u015fanlar\u0131n dikkat etmesi gerekenler<\/h2>\n\n\n\n<p>Ola\u011fan\u00fcst\u00fc fesih (genellikle bildirimsiz fesih olarak da adland\u0131r\u0131l\u0131r), i\u015f hukuku kapsam\u0131nda yaln\u0131zca istisnai durumlarda izin verilir. Ola\u011fan fesihten farkl\u0131 olarak, i\u015f ili\u015fkisi bildirim s\u00fcresi g\u00f6zetilmeksizin derhal sona erer.<\/p>\n\n\n\n<p>\u00d6n ko\u015ful, Alman Medeni Kanunu&#039;nun (BGB) 626. maddesi anlam\u0131nda \u00f6nemli bir sebeptir. Bu, i\u015f s\u00f6zle\u015fmesini fesheden ki\u015finin (ister i\u015fveren ister \u00e7al\u0131\u015fan olsun) normal ihbar s\u00fcresinin sonuna kadar i\u015f ili\u015fkisini s\u00fcrd\u00fcrmesinin makul bir \u015fekilde beklenemeyece\u011fi anlam\u0131na gelir.<\/p>\n\n\n\n<p>Bildirimsiz fesih i\u00e7in tipik nedenler \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>B\u00fcy\u00fck h\u0131rs\u0131zl\u0131k veya doland\u0131r\u0131c\u0131l\u0131k<\/li>\n\n\n\n<li>G\u00f6revi a\u011f\u0131r \u015fekilde ihlal etme (\u00f6rne\u011fin, \u00e7al\u0131\u015fmay\u0131 s\u00fcrekli reddetme, fiziksel sald\u0131r\u0131lar, ciddi hakaretler)<\/li>\n\n\n\n<li>G\u00fcven ihlali veya s\u0131rlar\u0131n if\u015fas\u0131<\/li>\n\n\n\n<li>End\u00fcstriyel bar\u0131\u015f\u0131n \u00f6nemli \u00f6l\u00e7\u00fcde bozulmas\u0131<br><\/li>\n<\/ul>\n\n\n\n<p>Bildirimsiz i\u015ften \u00e7\u0131karma yasal olarak zorlu ve \u00e7o\u011fu zaman tart\u0131\u015fmal\u0131 bir konudur. \u0130\u015f hukuku avukatlar\u0131m\u0131z, ge\u00e7erli bir sebep olup olmad\u0131\u011f\u0131n\u0131, t\u00fcm resmi gerekliliklerin kar\u015f\u0131lan\u0131p kar\u015f\u0131lanmad\u0131\u011f\u0131n\u0131 ve haks\u0131z fesih davas\u0131n\u0131n ba\u015far\u0131 \u015fans\u0131n\u0131n olup olmad\u0131\u011f\u0131n\u0131 inceleyecektir. Durumunuzu hemen de\u011ferlendirelim.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4\">\u0130\u015f Mahkemesinde \u0130\u015ften \u00c7\u0131karma \u2013 \u0130\u015ften \u00e7\u0131kar\u0131lma nedeninin nas\u0131l incelenece\u011fi<\/h2>\n\n\n\n<p>Feshin yasall\u0131\u011f\u0131 konusunda \u015f\u00fcpheleriniz varsa, bunu bir mahkemede g\u00f6zden ge\u00e7irebilirsiniz.<\/p>\n\n\n\n<p>Haks\u0131z fesih davas\u0131 ba\u011flam\u0131nda, i\u015f mahkemesi feshin yasal gerekliliklere uygun olup olmad\u0131\u011f\u0131n\u0131, \u00f6zellikle de usul\u00fcne uygun fesih durumunda Fesih Kar\u015f\u0131t\u0131 Koruma Yasas\u0131 (KSchG) kapsam\u0131nda sosyal olarak hakl\u0131 bir neden olup olmad\u0131\u011f\u0131n\u0131 veya bildirimsiz fesih durumunda hakl\u0131 bir neden olup olmad\u0131\u011f\u0131n\u0131 inceler. \u0130\u015fveren fesih nedenini ikna edici bir \u015fekilde a\u00e7\u0131klayamaz veya kan\u0131tlayamazsa, mahkeme feshi ge\u00e7ersiz ilan eder. Bu durumda, i\u015f ili\u015fkisi devam eder veya k\u0131dem tazminat\u0131 m\u00fczakere edilir.<br><strong><br><\/strong> Deneyimli i\u015f hukuku avukatlar\u0131m\u0131z, haks\u0131z fesih davalar\u0131nda sizi temsil edecek ve istihdam\u0131n\u0131z\u0131n devam\u0131n\u0131 veya adil bir k\u0131dem tazminat\u0131 alman\u0131z\u0131 sa\u011flayacakt\u0131r. Hemen bizimle ileti\u015fime ge\u00e7in ve \u00fccretsiz bir ilk de\u011ferlendirme al\u0131n.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"5\">Toplu i\u015f s\u00f6zle\u015fmelerinin ve \u00f6zel d\u00fczenlemelerin feshi \u2013 Bilmeniz gerekenler<\/h2>\n\n\n\n<p>Her fesih yaln\u0131zca genel yasal gerekliliklere dayanmaz.
