Mahkemeye g\u00f6re, bir nakliye \u015firketinin g\u00fcvenlikle ilgili s\u0131f\u0131r alkol politikas\u0131, bo\u015f zaman\u0131n yasal olarak \u00e7al\u0131\u015fma s\u00fcresi olarak kabul edilece\u011fi kadar \u00f6nemli bir k\u0131s\u0131tlama olu\u015fturmaz.<\/p>\n\n\n\n<p>Mahkeme ayr\u0131ca, \u00c7al\u0131\u015fma S\u00fcresi Direktifi&#039;ne ili\u015fkin Avrupa i\u00e7tihatlar\u0131n\u0131n denizcilere do\u011frudan uygulanabilir olmad\u0131\u011f\u0131n\u0131 vurgulad\u0131.<\/p>\n\n\n\n<p>Karar, denizcilik i\u015f hukukunda a\u00e7\u0131kl\u0131k sa\u011fl\u0131yor ve nakliye \u015firketleri, insan kaynaklar\u0131 departmanlar\u0131 ve i\u015f hukuku dan\u0131\u015fmanlar\u0131 i\u00e7in \u00f6nemli bir rehberlik sunuyor.<\/p>\n\n\n\n<p>\u00c7al\u0131\u015fma saatleri d\u00fczenlemeleri veya n\u00f6bet g\u00f6revleri konusunda yasal olarak sa\u011flam de\u011ferlendirmelere mi ihtiyac\u0131n\u0131z var? \u0130\u015f hukuku firmam\u0131z, sa\u011flam tavsiyeler ve kan\u0131tlanm\u0131\u015f \u00e7\u00f6z\u00fcmlerle size destek oluyor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\">LAG Hamburg: Gemide alkols\u00fcz bo\u015f zaman i\u00e7in tazminat hakk\u0131 yok<\/h2>\n\n\n\n<p>2007&#039;den beri \u00e7al\u0131\u015fan bir kaptan, gemideki alkols\u00fcz bo\u015f zamanlar\u0131n\u0131n \u00fccretli n\u00f6bet g\u00f6revi olarak kabul edildi\u011fini iddia ederek nakliye \u015firketinden 108.000 avronun \u00fczerinde bir \u00fccret talep etti. Bunun nedeni, uluslararas\u0131 nakliye \u015firketinin 2022 tarihli bir i\u00e7 yaz\u0131\u015fmas\u0131nda gemideki alkol yasa\u011f\u0131n\u0131 yinelemesiydi. Bu yasak, m\u00fcrettebat\u0131n acil bir durumda operasyonel olarak haz\u0131r olmas\u0131n\u0131 sa\u011flamay\u0131 ama\u00e7l\u0131yordu ve yasal bir dayana\u011f\u0131 olmasa bile i\u015f hukuku kapsam\u0131nda izin veriliyordu.<\/p>\n\n\n\n<p>Kaptan daha sonra 11.000 saati a\u015fan n\u00f6bet s\u00fcresi i\u00e7in yasal asgari \u00fccretin \u00f6denmesini talep etti. Hamburg \u0130\u015f Mahkemesi, ikinci derece mahkemede oldu\u011fu gibi, bu talebi reddetti. Her iki mahkeme de, n\u00f6bet d\u0131\u015f\u0131 saatlerde alkol t\u00fcketimine getirilen genel bir yasa\u011f\u0131n, n\u00f6bet g\u00f6revi i\u00e7in tazminat talebini hakl\u0131 \u00e7\u0131karacak kadar \u00f6nemli bir k\u0131s\u0131tlama olu\u015fturmad\u0131\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a belirtti.<\/p>\n\n\n\n<p>\u00c7al\u0131\u015fma saatleri, n\u00f6bet modelleri veya sekt\u00f6re \u00f6zg\u00fc d\u00fczenlemeler konusunda yasal netli\u011fe mi ihtiyac\u0131n\u0131z var? \u0130\u015f hukuku firmam\u0131z size derinlemesine dan\u0131\u015fmanl\u0131k sa\u011flamak i\u00e7in haz\u0131r. L\u00fctfen bizimle ileti\u015fime ge\u00e7in.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3\"><strong>LAG Hamburg: Alkol yasa\u011f\u0131 n\u00f6bet emri de\u011fildir<\/strong><\/h2>\n\n\n\n<p>Hamburg B\u00f6lge \u0130\u015f Mahkemesi karar\u0131nda bunu a\u00e7\u0131k\u00e7a belirtmi\u015ftir: Gemideki mevcut alkol yasa\u011f\u0131na yap\u0131lan at\u0131f, yeni bir i\u015f hukuku talimat\u0131 de\u011fil, yaln\u0131zca mevcut bir \u015firket i\u00e7i politikan\u0131n onay\u0131d\u0131r. \u0130nsan kaynaklar\u0131 departman\u0131, kaptana yaln\u0131zca s\u0131f\u0131r alkol s\u0131n\u0131r\u0131n\u0131n gelecekte i\u015f s\u00f6zle\u015fmesine a\u00e7\u0131k\u00e7a dahil edilmesini \u00f6nermi\u015ftir. Hakimler bunu yeni bir i\u015f hukuku emri olarak de\u011ferlendirmemi\u015ftir. Mahkeme, alkol yasa\u011f\u0131n\u0131n gemideki bo\u015f zaman aktivitelerini kesinlikle etkileyebilece\u011fini kabul etmekle birlikte, bu k\u0131s\u0131tlama n\u00f6bet g\u00f6revi anlam\u0131nda bir \u00fccret talebi te\u015fkil etmemektedir.<\/p>\n\n\n\n<p>Gemide s\u00fcrekli bulunmak, denizcilik mesle\u011finin tipik bir par\u00e7as\u0131d\u0131r. Dahas\u0131, alkol yasa\u011f\u0131 esas olarak gemideki genel g\u00fcvenli\u011fe hizmet eder; kaptan\u0131n s\u00fcrekli ula\u015f\u0131labilirli\u011fine de\u011fil.<\/p>\n\n\n\n<p>Serbest zaman\u0131n ne zaman n\u00f6bet \u00fccreti olarak \u00f6denebilece\u011fini merak ediyor musunuz? \u0130\u015f hukuku firmam\u0131z, \u00e7al\u0131\u015fma saati modelleri, i\u015fveren y\u00fck\u00fcml\u00fcl\u00fckleri ve \u00e7al\u0131\u015fan haklar\u0131 konusunda derinlemesine uzmanl\u0131\u011f\u0131yla size destek olabilir - bizimle ileti\u015fime ge\u00e7in!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4\">\u0130\u015f hukuku kapsam\u0131nda \u00f6zel bir durum olarak denizciler: Bekleme s\u00fcresi i\u00e7in \u00fccret alma hakk\u0131 yok<\/h2>\n\n\n\n<p>Hamburg B\u00f6lge \u0130\u015f Mahkemesi&#039;ne g\u00f6re, insan kaynaklar\u0131 departman\u0131 taraf\u0131ndan a\u00e7\u0131k bir n\u00f6bet emri verilmesi dahi herhangi bir tazminat hakk\u0131 do\u011furmazd\u0131. Ne bireysel i\u015f s\u00f6zle\u015fmesinde ne de ilgili toplu i\u015f s\u00f6zle\u015fmesinde (HTV-See), \u00fccretli n\u00f6bet s\u00fcresine ili\u015fkin h\u00fck\u00fcmler yer almamaktad\u0131r.<\/p>\n\n\n\n<p>Mahkeme ayr\u0131ca, toplu i\u015f s\u00f6zle\u015fmesinde denizcilerin genellikle bo\u015f zamanlar\u0131n\u0131 gemide ge\u00e7irdikleri ger\u00e7e\u011finin zaten dikkate al\u0131nd\u0131\u011f\u0131na dikkat \u00e7ekmektedir. Denizcilik istihdam ili\u015fkisinin bu \u00f6zelli\u011fi toplu i\u015f s\u00f6zle\u015fmesinde dikkate al\u0131nm\u0131\u015f olup, otomatik olarak ek \u00fccret talebine yol a\u00e7mamaktad\u0131r.<\/p>\n\n\n\n<p>\u0130ster bir nakliye \u015firketi, ister kaptan veya m\u00fcrettebat \u00fcyesi olun, denizdeki i\u015f hukuku davalar\u0131n\u0131z\u0131 uzmanl\u0131k ve \u00e7\u00f6z\u00fcm odakl\u0131 bir yakla\u015f\u0131mla inceleyece\u011fiz. Hemen bir dan\u0131\u015fmanl\u0131k randevusu al\u0131n!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"5\"><strong>Avrupa \u00c7al\u0131\u015fma S\u00fcresi Y\u00f6nergesi: \u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fan denizcilere avantaj sa\u011flanm\u0131yor<\/strong><\/h2>\n\n\n\n<p>Hamburg B\u00f6lge \u0130\u015f Mahkemesi, Avrupa \u00c7al\u0131\u015fma S\u00fcresi Direktifi&#039;nin (2003\/88\/EC say\u0131l\u0131 Direktif) kaptanlara iddia edilen bekleme s\u00fcreleri i\u00e7in tazminat hakk\u0131 tan\u0131mad\u0131\u011f\u0131n\u0131 a\u00e7\u0131kl\u0131\u011fa kavu\u015fturmu\u015ftur. Direktif, ger\u00e7ek dinlenme s\u00fcresi ile \u00e7al\u0131\u015fanlar\u0131n i\u015fyerinde i\u015fverene haz\u0131r bulunmalar\u0131 gereken bekleme s\u00fcresi aras\u0131nda a\u00e7\u0131k\u00e7a ayr\u0131m yapmaktad\u0131r.<\/p>\n\n\n\n<p>Avrupa Adalet Divan\u0131 (ABAD), n\u00f6bet g\u00f6revinin genel olarak \u00e7al\u0131\u015fma s\u00fcresi olarak s\u0131n\u0131fland\u0131r\u0131lmas\u0131 gerekti\u011fine, \u00f6zellikle de \u00e7al\u0131\u015fanlar\u0131n ola\u011fan ya\u015fam ortamlar\u0131n\u0131n d\u0131\u015f\u0131nda olduklar\u0131 ve bo\u015f zamanlar\u0131na s\u0131n\u0131rl\u0131 eri\u015fimleri oldu\u011fu durumlarda, bir\u00e7ok kez karar vermi\u015ftir.<\/p>\n\n\n\n<p>Ancak bu i\u00e7tihat bu \u00f6zel durumda uygulanmamaktad\u0131r. Denizciler, Madde 1(3) uyar\u0131nca Y\u00f6nerge kapsam\u0131n\u0131n a\u00e7\u0131k\u00e7a d\u0131\u015f\u0131nda tutulmu\u015ftur.<\/p>\n\n\n\n<p>\u00c7al\u0131\u015fma saatleri d\u00fczenlemeleri, n\u00f6bet\u00e7ilik veya sekt\u00f6re \u00f6zg\u00fc istisnalar konusunda hukuki a\u00e7\u0131dan sa\u011flam bir dan\u0131\u015fmanl\u0131k m\u0131 ar\u0131yorsunuz? \u0130\u015f hukuku firmam\u0131z, \u00fclke \u00e7ap\u0131nda yetkin, deneyimli ve \u00e7\u00f6z\u00fcm odakl\u0131 bir \u015fekilde size destek sa\u011fl\u0131yor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6\"><strong>Hamburg \u0130\u015f Mahkemesi: AB \u00c7al\u0131\u015fma S\u00fcresi Y\u00f6nergesi denizciler i\u00e7in ge\u00e7erli de\u011fil - alkol yasaksa \u00f6deme zorunlulu\u011fu yok<\/strong><\/h2>\n\n\n\n<p>Hamburg B\u00f6lge \u0130\u015f Mahkemesi \u015fu a\u00e7\u0131klamay\u0131 yapt\u0131: 1. Madde, 3. paragrafa g\u00f6re, Avrupa \u00c7al\u0131\u015fma S\u00fcresi Direktifi (2003\/88\/EC say\u0131l\u0131 Direktif) denizciler i\u00e7in a\u00e7\u0131k\u00e7a ge\u00e7erli de\u011fildir. Bunun yerine, Avrupa Toplulu\u011fu Gemi Sahipleri Dernekleri (ECSA) ve AB Ula\u015ft\u0131rma \u0130\u015f\u00e7ileri Sendikalar\u0131 Federasyonu (FST) aras\u0131nda 1998 tarihli \u00f6zel bir anla\u015fma, denizcilik sekt\u00f6r\u00fcnde ge\u00e7erlidir ve bu anla\u015fma, 1999&#039;dan beri Avrupa d\u00fczeyinde denizciler i\u00e7in \u00e7al\u0131\u015fma s\u00fcresi d\u00fczenlemelerini belirlemektedir.<\/p>\n\n\n\n<p>Sosyal ortak s\u00f6zle\u015fmesi olarak adland\u0131r\u0131lan bu s\u00f6zle\u015fme, bekleme s\u00fcresinin \u00fccretlendirilmesine ili\u015fkin herhangi bir genel h\u00fck\u00fcm i\u00e7ermemektedir.
