Klinik ciddi bir hata yapt\u0131: Yeni \u00e7al\u0131\u015fan\u0131n hassas sa\u011fl\u0131k verileri yeterince korunmam\u0131\u015ft\u0131. Birka\u00e7 hafta boyunca, \u00e7e\u015fitli klinik \u00e7al\u0131\u015fanlar\u0131, di\u011fer bilgilerin yan\u0131 s\u0131ra &quot;HIV&quot; te\u015fhisini de i\u00e7eren s\u00f6zde &quot;hasta ba\u015fvuru formuna&quot; eri\u015febildiler; ancak okunmas\u0131 zor bir formattayd\u0131.<\/p>\n\n\n\n<p>Sadece isim, adres, sa\u011fl\u0131k sigortas\u0131 sa\u011flay\u0131c\u0131s\u0131 ve \u00fc\u00e7 harfli &quot;HIV&quot; k\u0131saltmas\u0131 g\u00f6r\u00fcnse bile, bu hassas veri k\u00fcmesi engellenmeliydi. GDPR&#039;nin 82. maddesi uyar\u0131nca verilen 8.000 avroluk tazminat, belirli ko\u015fullar alt\u0131nda (\u00f6rne\u011fin, ek sa\u011fl\u0131k verileri etkilenmi\u015fse) daha da y\u00fcksek olabilirdi.<\/p>\n\n\n\n<p><strong>Hukuk b\u00fcromuz yan\u0131n\u0131zda<br><\/strong>\u0130\u015fyerinde veri koruma ihlalleri olmas\u0131 durumunda, tazminat da dahil olmak \u00fczere taleplerinizin kar\u015f\u0131lanmas\u0131nda uzman deste\u011fi sa\u011fl\u0131yoruz. \u0130\u015f hukuku alan\u0131ndaki deneyimimize g\u00fcvenin ve hassas verilerinizi korumak i\u00e7in birlikte \u00e7al\u0131\u015fal\u0131m.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\"><strong>Veri koruma hukukunda \u00e7\u0131\u011f\u0131r a\u00e7an karar: 8.000 avro tazminat \u00f6denmesine karar verildi<\/strong><\/h2>\n\n\n\n<p>Alman mahkemeleri, veri koruma ihlallerinden kaynaklanan manevi zararlar i\u00e7in tazminat verme konusunda uzun s\u00fcre isteksiz davrand\u0131. Bu t\u00fcr davalar genellikle \u00f6nemsiz kabul edildi ve yaln\u0131zca istisnai durumlarda tazminat talebi kabul edildi. Ancak bu k\u0131s\u0131tlay\u0131c\u0131 tutum, AB yasama organ\u0131n\u0131n a\u00e7\u0131k niyetiyle \u00e7eli\u015fmektedir.<\/p>\n\n\n\n<p>Federal Anayasa Mahkemesi, 14 Ocak 2021 tarihli karar\u0131nda (1 numaral\u0131 dava BvR 28531\/19) bunu a\u00e7\u0131k\u00e7a belirtmi\u015ftir: Mahkemeler, GDPR&#039;nin 82. maddesi kapsam\u0131ndaki iddialar\u0131, ispatlanamayan zarar iddias\u0131yla kesin olarak reddedemez. Soyut, maddi olmayan zararlar bile ac\u0131 ve \u0131zd\u0131rap tazminat\u0131 talebine yol a\u00e7abilir; ciddi bir zarar \u015fart\u0131 aranmaz.<\/p>\n\n\n\n<p>Ma\u011fdura 8.000 avro tazminat \u00f6denmesine karar verilen bu karar, Almanya&#039;da bug\u00fcne kadar bir veri koruma ihlali nedeniyle verilen en y\u00fcksek tazminat miktarlar\u0131 aras\u0131nda yer al\u0131yor. Hassas verilerin uygunsuz kullan\u0131m\u0131ndan kaynaklanan ki\u015fisel hak ihlallerinin ele al\u0131nmas\u0131nda \u00f6nemli bir d\u00f6n\u00fcm noktas\u0131 te\u015fkil ediyor.<\/p>\n\n\n\n<p>GDPR&#039;nin 82 (1) maddesi, veri koruma d\u00fczenlemelerinin ihlalleri i\u00e7in, zarar\u0131n maddi veya manevi olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n tazminat \u00f6denmesini \u00f6ng\u00f6rmektedir. GDPR&#039;nin 25 May\u0131s 2018&#039;de y\u00fcr\u00fcrl\u00fc\u011fe girmesiyle birlikte, veri koruma, yasal olarak uygulanabilir yeni bir koruyucu i\u015flev kazanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p><strong>Veri koruman\u0131z ihlal mi edildi? Haklar\u0131n\u0131z\u0131 koruyoruz.<br><\/strong>Tazminat, iptal, silme veya verilerinizin engellenmesine ihtiyac\u0131n\u0131z olsun: Deneyimli i\u015f hukuku avukatlar\u0131m\u0131z, ba\u011fl\u0131l\u0131k ve hukuki uzmanl\u0131klar\u0131yla yan\u0131n\u0131zdad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3\">Sonu\u00e7: Veri koruma ihlalleri i\u00e7in tazminat\u0131 g\u00f6z ard\u0131 etmeyin<\/h2>\n\n\n\n<p>Veri koruma ihlalinden etkilenen herkes, yaln\u0131zca verilerinin d\u00fczeltilmesi veya silinmesi konusunda \u0131srarc\u0131 olmakla kalmamal\u0131, ayn\u0131 zamanda olas\u0131 tazminat taleplerini de de\u011ferlendirmelidir. GDPR&#039;nin 82. maddesine g\u00f6re, manevi zararlar bile tazmin edilebilir.<\/p>\n\n\n\n<p>Hukuki masraf sigortas\u0131, ihlal an\u0131nda sigorta kapsam\u0131n\u0131n zaten mevcut olmas\u0131 ve bekleme s\u00fcresinin dolmu\u015f olmas\u0131 ko\u015fuluyla, genellikle ortaya \u00e7\u0131kan masraflar\u0131 kar\u015f\u0131lar.
