S\u00f6zle\u015fmesinde sabit bir haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi de\u011fil, ihtiya\u00e7 halinde istihdam \u00f6ng\u00f6r\u00fcl\u00fcyordu. Davac\u0131, Yar\u0131 Zamanl\u0131 ve Belirli S\u00fcreli \u0130stihdam Yasas\u0131&#039;n\u0131n (TzBfG) 12. Maddesi 1. F\u0131kras\u0131 3. C\u00fcmlesi&#039;ne dayanarak, bir anla\u015fman\u0131n olmamas\u0131 durumunda, 20 saatlik d\u00fczenli haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin kararla\u015ft\u0131r\u0131lm\u0131\u015f say\u0131ld\u0131\u011f\u0131n\u0131 ileri s\u00fcrd\u00fc. Asl\u0131nda daha az s\u0131kl\u0131kta g\u00f6revlendirildi\u011fi i\u00e7in, toplam 316,6 kullan\u0131lmayan saat i\u00e7in geriye d\u00f6n\u00fck \u00fccret talep etti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\">Mini i\u015flerde h\u00fck\u00fcm: Azami \u00e7al\u0131\u015fma saatlerinin a\u015f\u0131lmas\u0131 durumunda geriye d\u00f6n\u00fck \u00f6deme yap\u0131lmayacak<\/h2>\n\n\n\n<p>Berlin-Brandenburg B\u00f6lge \u0130\u015f Mahkemesi (LAG), minijob \u00e7al\u0131\u015fan\u0131n\u0131n yasal olarak \u00f6ng\u00f6r\u00fclen haftal\u0131k azami 48 saatlik \u00e7al\u0131\u015fma s\u00fcresiyle zaten tamamen me\u015fgul olmas\u0131 nedeniyle geriye d\u00f6n\u00fck \u00fccret almaya hak kazanamayaca\u011f\u0131na karar verdi (\u00a7 3 ArbZG).<\/p>\n\n\n\n<p>Kararda ayr\u0131ca \u015fu husus da a\u00e7\u0131k\u00e7a belirtiliyor: \u00c7al\u0131\u015fma saatleri konusunda a\u00e7\u0131k bir s\u00f6zle\u015fme anla\u015fmas\u0131 yoksa, 657 say\u0131l\u0131 K\u0131smi S\u00fcreli ve Belirli S\u00fcreli \u00c7al\u0131\u015fma Kanunu&#039;nun (TzBfG) 12. maddesi uyar\u0131nca, bir uyu\u015fmazl\u0131k halinde haftal\u0131k 20 saatlik \u00e7al\u0131\u015fma s\u00fcresinin z\u0131mnen kararla\u015ft\u0131r\u0131lm\u0131\u015f say\u0131labilece\u011fi, bunun da i\u015fverenler a\u00e7\u0131s\u0131ndan olas\u0131 sonu\u00e7lar do\u011furabilece\u011fi belirtiliyor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3\">\u00d6nemli karar: Mini i\u015flerde \u00e7al\u0131\u015fma saatleri d\u00fczenlemesinin olmamas\u0131 i\u015fverenler i\u00e7in risk olu\u015fturuyor<\/h2>\n\n\n\n<p>Berlin-Brandenburg B\u00f6lge \u0130\u015f Mahkemesi&#039;nin karar\u0131, s\u00f6zle\u015fmede a\u00e7\u0131k\u00e7a tan\u0131mlanm\u0131\u015f \u00e7al\u0131\u015fma saatleri olmayan yar\u0131 zamanl\u0131 \u00e7al\u0131\u015fanlar\u0131 \u00e7al\u0131\u015ft\u0131ran i\u015fverenler i\u00e7in riskleri vurguluyor. Herhangi bir \u00e7al\u0131\u015fma saati \u00fczerinde anla\u015fmaya var\u0131lmamas\u0131 durumunda, \u00f6zellikle i\u015f ili\u015fkisinin sona ermesinden sonra, kullan\u0131lmad\u0131\u011f\u0131 iddia edilen saatler i\u00e7in geriye d\u00f6n\u00fck \u00fccret talep etme riski bulunmaktad\u0131r.<\/p>\n\n\n\n<p>\u00d6zellikle esnek \u00e7al\u0131\u015fanlara talebin y\u00fcksek oldu\u011fu catering veya perakende gibi sekt\u00f6rlerde bu t\u00fcr ek talepler finansal riskler yaratabiliyor, hatta a\u015f\u0131r\u0131 durumlarda i\u015fletmenin varl\u0131\u011f\u0131n\u0131 tehdit edebiliyor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4\">\u0130\u015fverenlerin bir sorumlulu\u011fu var: \u00c7al\u0131\u015fma saatleri a\u00e7\u0131k\u00e7a tan\u0131mlanmam\u0131\u015f mini i\u015fler hukuki riskler ta\u015f\u0131yor.<\/h2>\n\n\n\n<p>Bir\u00e7ok yar\u0131 zamanl\u0131 \u00e7al\u0131\u015fan, haftal\u0131k \u00e7al\u0131\u015fma saatleri konusunda yaz\u0131l\u0131 bir anla\u015fma olmaks\u0131z\u0131n \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fmaktad\u0131r. Berlin-Brandenburg B\u00f6lge \u0130\u015f Mahkemesi&#039;nin (LAG) yak\u0131n zamanda verdi\u011fi bir karar, bunun i\u015fverenler i\u00e7in ne kadar riskli olabilece\u011fini g\u00f6stermektedir: A\u00e7\u0131k bir s\u00f6zle\u015fmesel anla\u015fma olmadan, yar\u0131 zamanl\u0131 \u00e7al\u0131\u015fanlar, i\u015f akdinin feshedilmesinden sonra kullan\u0131lmayan saatler i\u00e7in geriye d\u00f6n\u00fck olarak \u00fccret talep edebilirler; bu, i\u015f ili\u015fkisinin t\u00fcm s\u00fcresi boyunca ge\u00e7erlidir.<\/p>\n\n\n\n<p>\u00d6zellikle \u00e7a\u011fr\u0131 usul\u00fc s\u00f6zle\u015fme yapan \u015firketlerde bu durum, en k\u00f6t\u00fc ihtimalle \u015firketin ekonomik varl\u0131\u011f\u0131n\u0131 tehlikeye atabilecek \u00f6nemli miktarda geri \u00f6demeye yol a\u00e7abilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"5\"><strong>Mini i\u015f karar\u0131ndan al\u0131nacak ders: Net \u00e7al\u0131\u015fma saatleri d\u00fczenlemelerinin neden vazge\u00e7ilmez oldu\u011fu<\/strong><\/h2>\n\n\n\n<p>Berlin-Brandenburg B\u00f6lge \u0130\u015f Mahkemesi&#039;nin karar\u0131 bunu a\u00e7\u0131k\u00e7a ortaya koyuyor: \u00c7al\u0131\u015fma saatlerine ili\u015fkin a\u00e7\u0131k s\u00f6zle\u015fme anla\u015fmalar\u0131 olmadan, i\u015fverenler, \u00f6zellikle mini i\u015fler alan\u0131nda, y\u00fcksek maliyetli geri \u00f6deme talepleriyle kar\u015f\u0131 kar\u015f\u0131ya kal\u0131yor. Esnek \u00e7al\u0131\u015fma saatleri modellerine dayanan konaklama sekt\u00f6r\u00fc ve perakende gibi sekt\u00f6rler \u00f6zellikle etkileniyor.<\/p>\n\n\n\n<p>Haftal\u0131k \u00e7al\u0131\u015fma saatleri konusunda yaz\u0131l\u0131 bir anla\u015fma, daha sonra do\u011fabilecek davalara ve hukuki uyu\u015fmazl\u0131klara kar\u015f\u0131 etkili bir koruma sa\u011flar.<\/p>\n\n\n\n<p>Federal \u0130\u015f Mahkemesi (BAG, 10.08.2022 \u2013 5 AZR 154\/22) daha \u00f6nce \u015fu hususu a\u00e7\u0131kl\u0131\u011fa kavu\u015fturmu\u015ftu: A\u00e7\u0131k y\u00f6nergelerin olmamas\u0131 veya i\u015fverenin talimatlar\u0131n\u0131n mant\u0131ks\u0131z olmas\u0131 durumunda bu durum kabul\u00fcn temerr\u00fcde d\u00fc\u015fmesine ve \u00f6deme taleplerine yol a\u00e7abilir.<\/p>\n\n\n\n<p>Bu nedenle \u015firketlerin s\u00f6zle\u015fme \u015fablonlar\u0131n\u0131 acilen g\u00f6zden ge\u00e7irmeleri ve hukuki tuzaklara d\u00fc\u015fmemek i\u00e7in gerekti\u011finde uyarlamalar\u0131 gerekmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6\">Proaktif \u00f6nlemler: A\u00e7\u0131k i\u015f s\u00f6zle\u015fmeleri, gecikme cezas\u0131 riskine kar\u015f\u0131 koruma sa\u011flar.<\/h2>\n\n\n\n<p>\u0130\u015fverenler hemen harekete ge\u00e7meli: Mini i\u015f s\u00f6zle\u015fmelerinde a\u00e7\u0131k ve yaz\u0131l\u0131 \u00e7al\u0131\u015fma saatleri d\u00fczenlemeleri, yasal tuzaklardan ka\u00e7\u0131nmak i\u00e7in olmazsa olmazd\u0131r.
